M AM <br />61- UMN <br />KI KI I MLIJ NUT 1113011 <br />A RESOL UTION APPR 0 VING THE DE VEL OPER'S A GREEMENT FOJ <br />SA VONA 2' ADDITION <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, U.S. Home Corporation (d/b/a Lennar), 16305 36t" Avenue North, Suite <br />600., PIkIngouth, MN Li,"Agus licant",'�,, has jvreviousl 0 s aft <br />Elmo ("City") for a Final Plat for Savona 2'id Addition; and <br />WHEREAS, the Lake Elmo City Council considered and approved the Preliminary Plat <br />request for Savona at a meeting held on August 6, 2013; and <br />WHEREAS, The Lake Elmo City Council adopted Resolution No. 2014-076 on <br />September 16, 2014 approving the Final Plat for Savona; and <br />WHEREAS, Condition (2) of said Resolution No. 2014-076 establishes that, prior to the <br />execution of the Final Plat by City officials, the Applicant is to enter into a Developer's <br />Agreement with the City; and <br />WHEREAS, the Applicant and City have agreed to enter into such a contract, and a copy <br />of the Developer's Agreement was submitted to the City Council for consideration at its <br />September 16, 2014 meeting. <br />NOW, THEREFORE, based on the information received, the City Council of the City <br />of Lake Elmo does hereby approve the Developer's Agreement for Savona 2"d Addition and <br />authorizes the Mayor and City Clerk to execute the document. <br />Passed and duly adopted this 16 th day of September 2014 by the City Council of the City of Lake <br />Elmo, Minnesota. <br />Iliike Pearson, Mayor <br />am Bell,(�ity Clerk <br />
