L11 <br />RESOLUTION NO. 2014-96 <br />7-RENOL UJIUN T??ATMNG--A CUUPLIUTTFIE7?7t'*E'IE70LNI'WIIH WANHING] UN CUUNTY 10 <br />F,ACILITATE ALL RIGHT OF WAY ACQUISITION FOR THE LAKE ELMO AVE DOWNTO1FN <br />STREETAND UTILITYPROJECT <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing under the <br />laws of the State of Minnesota; and <br />WHEREAS, the City and Washington County intend to reconstruct County State Aid Highway <br />(CSAH) 17 (Lake Elmo Avenue) from Trunk Highway (TH) 5 to 30t" Street North in the City of Lake <br />Elmo; and <br />WHEREAS, the City and County intend to reconstruct 30t" Street North, Upper 33rd Street North, <br />36t" Street North and Laverne Avenue North, all local streets in the City of Lake Elmo, as part of the <br />project; and <br />WHEREAS, the construction of streets and utilities associated with the project will require the <br />acquisition of permanent right of way, permanent easements, and temporary easements; and <br />WHEREAS, the preliminary right of way cost estimate has been prepared by the County and the <br />City will participate in the right of way costs in accordance with the Revised Draft County Cost <br />Participation Policy for Projects Constructed in Washington County Using State Aid Funds or Local Tax <br />Levy Dollars dated September 30, 2014; and <br />WHEREAS, a cooperative agreement between the City and County is the appropriate method to <br />facilitate the right of way acquisition; and <br />NOW, THEREFORE, BE IT RESOLVED THAT the City Council does hereby approve the <br />Cooperative Agreement Between the City of Lake Elmo and Washington County for Right of Way Cost <br />for the Lake Elmo Avenue Downtown Street and Utility Project. <br />Passed and duly adopted this 2 nd day of December 2014 by the City Council of the City of Lake Elmo, <br />Minnesota, <br />Mike Pearson, Mayor <br />4ABell, City Clerk <br />Resolution No. 2014-96 <br />
