(304.320) <br />C. Alteration of Watercours(,.s <br />1. The Zoning Administration shall notify adjacent <br />communities and the (State coordinating agency) <br />prior to any alteration or relocation of a water- <br />course, and submit evidence of such notification <br />to the Federal Insurance Administration. <br />2. The City shall require that maintenance is pro- <br />vided within the altered or relocated portion <br />of said watercourse so that the flood carrying <br />capacity is not diminished. <br />304.330 Variances, Appeals, and Conditional Use Permits. <br />A. Variances and Appeals. The Board of Adjustments <br />shall hear and decide variances and appeals where it <br />is alleged there is error in any order, requirement, <br />decision, or determination made by an administrative <br />official in enforcement or administration of this <br />Ordinance, as provided by the Zoning Ordinance. <br />1. The Zoning Administrator shall notify by mail, <br />the Commissioner of Natural Resources of an <br />application for Variance or an appeal ten (10) <br />days before hearing on the request. <br />2. No Variance shall have the effect of allowing <br />in any district uses prohibited in that district, <br />permit a lower degree of flood protection than <br />the Regulatory Flood Protection Elevation for <br />the particular area, or permit standards lower <br />than those required by State law. <br />-12 'mendef. by Ord. 7938 <br />
