STATE OF MINNESOTA <br />COUNTY OF WASHINGTON <br />CITY OF LAKE ELMO <br />ORDINANCE 8078 <br />The Lake Elmo City Council ordains that Section 401.042(A)2. <br />is hereby amended and Section 401.042(A)3. is hereby added <br />to the Lake Elmo Municipal Code to read as follows: <br />2. In those cases where the City Council determines that it <br />is not reasonably possible for each such resultant parcel to <br />comply with the provisions of Section 401.042(A)(1). each <br />resultant parcel when combined with an abutting parcel <br />through an approved lot consolidation procedure shall at <br />least cause a currently nonconforming lot to become less <br />nonconforming or, <br />3. Agricultural or Rural Residential zoning districts, <br />where the City Council determines that it is not reasonably <br />possible for one of the resultant parcels to have a 300 foot <br />frontage on a publicly improved right-of-way; provided that <br />such parcel shall be served by a restrictive access which is <br />protected by a restrictive covenant which includes the city <br />as a beneficiary. <br />EFFECTIVE DATE: This ordinance shall be effective the day <br />following its publication. <br />ADOPTION DATE: Passed by the City Council of the City of <br />Lake Elmo the 19th day of January, 1993. <br />W ohn, Mayor <br />ATTEST: <br />ary ef'f City Administrator <br />Publication Date: This ordinance or an approved summary, <br />thereof, was published on the 10th day of February, 1993. <br />
