STAFF REPORT <br />DATE: January 17, 2023 <br /> CONSENT <br /> <br />AGENDA ITEM: Approve City Oversize Cost Reimbursements for Wildflower at Lake Elmo 3rd Addition. <br /> SUBMITTED BY: Jack Griffin, City Engineer REVIEWED BY: Kristina Handt, City Administrator Marty Powers, Public Works Director Sophia Jensen, Planner Chad Isakson, Assistant City Engineer <br /> ISSUE BEFORE COUNCIL: Should the City Council approve payment for the city oversize cost reimbursements for the Wildflower at Lake Elmo 3rd Addition? BACKGROUND: The City Council approved a Development Agreement for the Wildflower at Lake Elmo 3rd Addition, dated April 17, 2018. The Public Improvements, including sanitary sewer, watermain, storm sewer and storm water management, street construction, sidewalks and trails were constructed and accepted by the city on July 6, 2021. PROPOSAL DETAILS/ANALYSIS: Staff has received and processed a request for city reimbursement for the trunk watermain and trunk sanitary sewer pipe oversizing costs related to the Wildflower 3rd Addition. This request has been reviewed and is being recommended for approval in accordance with the <br />approved Development Agreement, and contingent on the developer being current with all other payments and obligations in accordance with the Development Agreement, including a positive escrow balance as required by the City. <br /> FISCAL IMPACT: Oversize payments are recommended in the amounts of $5,288.00 for trunk watermain oversize costs, and $3,208.00 for trunk sanitary sewer oversize cost. RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda, and approve payment for the city oversize cost reimbursements for the Wildflower at Lake Elmo 3rd Addition, contingent on the developer being current with all other payments and obligations in accordance with the Development Agreement, including a positive escrow balance as required by the City. If removed from the consent agenda, the recommended motion for the action is as follows: “Move to approve payment for the city oversize cost reimbursements for the Wildflower 3rd Addition, contingent on the developer being current with all other payments and obligations in accordance with <br />the Development Agreement, including a positive escrow balance as required by the City”. <br />ATTACHMENTS: <br />1.
