Motion passed 4 - 0. <br /> <br />ITEM 13: Impervious Surface Text Amendment <br /> <br />City Planner Jensen presented proposed amendments to the impervious surface definitions in the <br />city’s zoning code to state that decks, pervious landscape fabric, surface water of pools and <br />retaining walls are not impervious surface. <br /> <br />Councilmember McGinn, seconded by Councilmember Holtz, moved TO ADOPT <br />ORDINANCE 2023-01 AMENDING THE IMPERVIOUS SURFACE DEFINITION IN <br />SECTION 1.08.010. Motion passed 4 – 0. <br /> <br />Councilmember McGinn, seconded by Councilmember Holtz, moved TO ADOPT <br />RESOLUTION 2023-07 AUTHORIZING SUMMARY PUBLICATION OF ORDINANCE <br />2023-01. Motion passed 4 – 0. <br /> <br />ITEM 14: Upper 33rd Conditional Use Permit <br />City Planner Jensen reviewed the conditional use permit application to construct a four unit <br />townhome building on Upper 33rd Street, west of Lake Elmo Avenue. <br /> <br />Susan Dunn, 11013 Upper 33rd Street, expressed concern over stormwater ponding, prospective <br />tenant screening, building compatibility with neighborhood character, HOA management of <br />property, traffic concerns and potential loss of trees. <br /> <br />Elizabeth Niehaus, 2945 Lake Elmo Avenue, expressed concern over parking limitations and <br />additional demand for on street parking generated by the townhome building. <br /> <br />Brief discussion held regarding parking. Councilmember Holtz stated he would abstain from a <br />vote due to his relationship with a neighbor of this project. <br /> <br />Councilmember Holtz, seconded by Mayor Cadenhead, moved TO APPROVE A <br />CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A FOUR UNIT <br />TOWNHOME BULIDING AT THE PROPERTIES DESCRIBED AS LOTS 10 AND 11,
