STAFF REPORT <br />DATE: 2/21/2023 <br />CONSENT <br />TO: City Council FROM: Sophia Jensen, City Planner <br />AGENDA ITEM: Text Amendments Park Dedication Requirement Code <br />INTRODUCTION: <br />City of Lake Elmo has initiated a text amendment to City Code Section 103.00.150 Park Dedication Requirements to add missing zoning districts, Village High Density Residential (V-HDR) and Village Medium Density Residential (V-MDR), to the minimum required land dedication table. The Village Low Density Residential zoning district is already in the 10% land <br />dedication portion of the table. Including these two missing districts in the 10% land dedication will follow suit with the requirements of sewered residential development. <br />ISSUE BEFORE THE CITY COUNCIL: Should City Council adopt the proposed text amendments to the City Code? <br />TEXT AMENDMENT DETAILS/ANALYSIS: New language is underlined. <br />103.00.150 Park Land Dedication Requirements <br />a.Dedication of land for park and open space use. In all new residential subdivisions, apercentage of the gross area of all property subdivided shall be dedicated for parks, <br />playgrounds, trails, public open space, or other public recreational use. For nonresidentialdevelopments, the city requires a payment in lieu of land dedication as established byresolution of the city council. Such percentage or fee shall be in addition to the propertydedicated for streets, alleys, waterways, pedestrian ways or other public use pursuant tothis title. The following schedule describes the required dedication by zoning district. <br />This schedule is based upon density of the development allowed in each district and isintended to equalize the amount and value of land dedicated for parks per dwelling unit inthe various districts. <br />Zoning Districts Minimum Required Land Dedication <br />V-LDR, V-MDR, V-HDR, GCC, LDR, MDR, HDR 10 percent <br />RS, AG, RE, RR (Rural Districts) 5 percent <br />C, CC, LC, BP, VMX, MU-BP, MU-C Fees as set by Council resolution a
