The flood insurance rate map panels adopted by reference in subsection (b) of this <br />section may include floodplain areas that lie outside of the corporate boundaries of the city at <br />the time of adoption of this chapter. If any of these floodplain land areas are annexed into the <br />city after the date of adoption of this chapter, the newly annexed floodplain lands shall be <br />subject to the provisions of this chapter immediately upon the date of annexation into the city. <br />HISTORY <br />Adopted by Ord. 08-253 on 11/3/2021 <br />100.00.030 Establishment Of Zoning Districts <br />(a)Districts. <br />(1)Floodway district. The floodway district shall include those areas designated as floodway <br />on the flood insurance rate map adopted in LEC 100.00.020(b). <br />(2)Flood fringe district. The flood fringe district shall include those areas designated as <br />floodway fringe. The flood fringe district shall include those areas shown on the flood <br />insurance rate map as adopted in LEC 100.00.020(b) as being within Zone AE but being <br />located outside of the floodway. <br />(3)General floodplain district. The general floodplain district shall include those areas <br />designated as Zone A or Zone AE without a floodway on the flood insurance rate map <br />adopted in LEC 100.00.020(b). <br />(b)Compliance. No new structure or land shall hereafter be used and no structure shall be <br />constructed, located, extended, converted, or structurally altered without full compliance with the <br />terms of this chapter and other applicable regulations which apply to uses within the jurisdiction <br />of this chapter. Within the floodway, flood fringe and general floodplain districts, all uses not <br />listed as permitted uses or conditional uses in LEC 100.00.040 through LEC 100.00.060, <br />respectively, shall be prohibited. In addition, a caution is provided here that: <br />(1)New manufactured homes, replacement manufactured homes and certain travel trailers <br />and travel vehicles are subject to the general provisions of this chapter and specifically <br />LEC 100.00.090. <br />(2)Modifications, additions, structural alterations, normal maintenance and repair, or repair <br />after damage to existing nonconforming structures and nonconforming uses of structures <br />or land are regulated by the general provisions of this chapter and specifically LEC <br />100.00.110. <br />(3)As-built elevations for elevated or floodproofed structures must be certified by ground <br />surveys and floodproofing techniques must be designed and certified by a registered <br />professional engineer or architect as specified in the general provisions of this chapter <br />and specifically as stated in LEC 100.00.100. <br />HISTORY <br />Adopted by Ord. 08-253 on 11/3/2021 <br />100.00.040 Floodway District (FW) <br />(a)Permitted uses. <br />(1)Agricultural uses such as general farming, pasture, grazing, outdoor plant nurseries, <br />horticulture, truck farming, forestry, sod farming, and wild crop harvesting. <br />(2)Industrial-commercial loading areas, parking areas, and airport landing strips.
