City Council – Staff Report <br />Page 2 <br /> <br />• That the developer provide a cash deposit of $242,303.00 for WAC, SAC, AUAR Fee, <br />Railroad Crossing and engineering/administration escrow. <br />• There are outstanding issues with trail easements to be dedicated to the City. Outlot J was <br />previously required to have an easement in favor of the City, however Outlot J has been <br />dedicated to the City so a separate easement is not needed. If the City were to convey the <br />parcel and retain the trail in the future, then an easement would be required at that time. <br />The other easement issue relates to Outlot E of the first addition. There is a D&U easement <br />over the entire parcel and a trail connection has been constructed in the outlot. However, <br />a trail easement has not been conveyed. Outlot E is now owned by the HOA. A condition <br />is included for the developer to prepare the legal description and facilitate said easement. <br />• The temporary construction easement granted in 2020 to accommodate Village Parkway <br />UP Railroad Crossing is to be extended until Feb 28, 2029. <br /> <br />Upon execution of this Agreement, receipt of all fees and securities, recording of the final plat and <br />the completion of a preconstruction meeting with the City, construction can commence. The <br />developer has indicated a start date in spring 2024. <br />FISCAL IMPACT: <br />The future financial impacts include maintenance of sanitary sewer mains, watermains and other <br />public infrastructure, maintenance of storm water ponding areas (after warranty period), and other <br />public financial responsibilities typically associated with a new development. The City will collect <br />any necessary building permit fees, city utility connection charges, and Metro SAC fees at the time <br />of building permit application. City WAC and SAC are required to be paid prior to recording of <br />the final plat. <br />OPTIONS: <br /> <br />The City Council is being asked to consider the approval of the developer’s agreement and has the <br />following options: <br />1) Adopt Resolution 2024-033 approving the developer agreement for Easton Village 6th and <br />7th Additions; or <br />2) Direct Staff to amend the draft developer agreement to bring back to a future City Council <br />meeting. <br /> <br />RECOMMENDATION: <br /> <br />Staff recommends the City Council adopt Resolution 2024-033 approving the developer’s <br />agreement for Amira Lake Elmo with the following motion: <br />“Move to adopt Resolution 2024-033 approving the developer’s agreement for <br />Easton Village 6th and 7th Additions”
