<br />17 <br />LA515\89\721081.v13 <br />F. The Developer shall pay in full all bills submitted to it by the City for obligations <br />incurred under this Agreement within 30 days after receipt. Bills not paid within 30 <br />days shall be assessed a late fee per the City adopted fee schedule. Upon request, <br />the City will provide copies of detailed invoices of the work performed by the City <br />and its consultants. <br />29. RAILROAD CROSSING IMPROVEMENTS. The Developer shall be required to pay <br />for a portion of the costs to secure, build and install a public rail crossing on Village Parkway to <br />specifications required by the City, the Minnesota Department of Transportation, Union Pacific <br />Railroad and any other regulatory agency having jurisdiction over the crossing and the track in <br />accordance with the specifications of the City. The Developer’s portion of these costs shall be <br />calculated based on the percentage of the overall number of Residential Equivalency Connection <br />(REC) units planned for developments that will have access to Village Parkway between <br />Washington County Highway 14 and 30th Street North divided by the estimated overall project <br />costs. The City will request that all future development projects connecting directly to Village <br />Parkway contribute towards said crossing improvement. <br />A. The amount of the cash payment for the railroad crossing for Easton Village 6th <br />and Easton Village 7th Additions shall be $23,160.00, which was calculated as <br />follows: $193,000 (Easton Village’s share of the estimated project costs multiplied <br />by 12% (27 lots out of 217 lots in all phases) = $23,160.00. <br />B. If the construction amount of the railroad crossing installation exceeds $500,000, <br />the additional cost shall be allocated proportionally among the development <br />projects connecting directly to Village Parkway parcels, including the Subdivision, <br />upon consent of all property owners and the City. The City may participate in the <br />additional costs of construction of the railroad crossing if the City Council deems <br />it to be necessary as a matter of public safety.
