<br />4 <br />LA515\89\721081.v13 <br />lots and blocks. <br />5. PRELIMINARY PLAT STATUS. The Subdivision is a part of the preliminary plat of <br />Easton Village as it was approved by the City in 2014 and was platted as an outlot in Easton <br />Village 1st Addition. The parties agree that the preliminary plat of Easton Village shall remain in <br />effect with respect to the Subdivision. The final plats of the Subdivision shall be recorded with <br />Washington County by the Developer no later than February 11, 2025. Should the final plats not <br />be recorded within this timeframe, the final plats of the Subdivision and the preliminary plat of <br />Easton Village shall expire with respect to the property. <br />6. CHANGES IN OFFICIAL CONTROLS. For five years from the date of this Agreement, <br />no amendments to the City’s Comprehensive Plan or official controls shall apply to or affect the <br />use, development density, lot size, lot layout, or dedications of the approved final plats unless <br />required by state or federal law or agreed to in writing by the City and the Developer. Thereafter, <br />notwithstanding anything in this Agreement to the contrary, to the full extent permitted by state <br />law, the City may require compliance with any changes to the City’s Comprehensive Plan, official <br />controls, platting, or dedication requirements enacted after the date of this Agreement. <br />7. DEVELOPMENT PLANS. The Developer agrees to develop the Subdivision in <br />accordance with the City approvals, including the terms and conditions of approval of the final <br />plats as detailed in City Council Resolution Nos. 2022-118, 2023-053, 2024-017, 2023-079 and <br />2024-016 to construct all improvements in accordance with the approved construction plans and <br />specifications (collectively, the “Plans”) prepared by a professional engineer registered in the <br />State of Minnesota at its sole expense. All terms and conditions of the City approvals are hereby <br />incorporated by reference into this Agreement. The documents which constitute the Plans are <br />those on file with and approved by the City and are listed on Exhibit B attached hereto. The <br />Plans may not be modified by the Developer without the prior written approval of the City. <br />8. IMPROVEMENTS. In developing the Subdivision in accordance with the Plans, the
