1 <br />LA515-119-856339.v1 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 2024-034 <br /> <br />A RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR NORTH STAR <br /> <br /> <br /> WHEREAS, the City of Lake Elmo (the “City”) is a municipal corporation organized and <br />existing under the laws of the State of Minnesota; and <br /> <br /> WHEREAS, GWSA Land Development, LLC, a limited liability company (the <br />“Applicant”) previously submitted an application to the City for a final plat and final PUD plan <br />for North Star; and <br /> <br /> WHEREAS, the Lake Elmo City Council adopted Resolution No. 2023-074 on August <br />15, 2023 approving the final plat and final PUD plan for North Star (the “Resolution”); and <br /> <br /> WHEREAS, the conditions of approval of the final plat and final PUD plan in Resolution <br />2023-074 included a requirement that the Applicant enter into a development agreement <br />acceptable to the City Attorney and approved by the City Council that delineates who is <br />responsible for the design, construction, and payment of the required improvements with financial <br />guarantees therefore; and <br /> <br />WHEREAS, the Lake Elmo City Council adopted Resolution No. 2023-108 on November <br />8, 2023, approving the development agreement for North Star; and <br /> <br />WHEREAS, the Lake Elmo City Council adopted Resolution No. 2024-012 on January <br />16, 2024 approving an extension to record the final plat for North Star; and <br /> <br />WHEREAS, the Applicant and City have not yet executed or recorded the development <br />agreement or plat for North Star and revisions to the development agreement have been requested <br />by the Applicant to Section 27 of the development agreement; and <br /> <br /> NOW, THEREFORE, the City Council of the City of Lake Elmo hereby approves the <br />revised Development Agreement for North Star and authorizes the Mayor and City Clerk to <br />execute it. <br /> <br /> <br /> <br /> <br /> <br /> <br />
