3 <br />City Staff has also reviewed the DNRs regulations on nonconforming lots in shoreland areas and <br />the request meets the four requirements outlined below: <br />1. The proposed lots are at least 66% of the lot area and width requirements. <br />2. The Lots are connected to City Sewer. <br />3. Neither lot exceeds 25% impervious surface. <br />4. The request is consistent with the Comprehensive Plan. <br />CITY AGENCY REVIEW: <br />This request was distributed to several departments and agencies for review on March lst 2024. <br />The following departments provided comments: <br />• Valley Branch Watershed District (2/16/2024) Indicated a permit would be required. <br />• Fire Department Email (2/27/2024) provided comments regarding the address numbers of <br />the lots. A condition regarding addressing has been added based on this commentary. <br />• City Engineer Email (3/1/2024) Noted that each property is connected to sewer, noted a <br />condition of approval for private systems, easement encroachment, and curb cuts. Staff <br />notes that that each home is connected to sewer and water. Easements are proposed to be <br />dedicated equally for each lot. Conditions of approval are included for easement <br />encroachments and driveway access removal. <br />• MN DNR — Did not provide any comments. <br />PUBLIC COMMENT: <br />A hearing notice was sent to surrounding properties on February 28th, 2024. A hearing notice <br />was published in the local newspaper on March Is', 2024. No public comment has been received. <br />PLANNING COMMISSION: <br />The Planning Commission reviewed this request at their March llth 2024 meeting. The <br />Commission voted to recommend approval of the request (5-0). <br />FISCAL IMPACT: <br />None <br />RECOMMENDED CONDITIONS OF APPROVAL <br />l . To comply with the DNR nonconforming shoreland lots, neither property shall exceed <br />25% impervious surface with any current or future development. <br />2. The structure setback variances apply only to the existing garage and house on Lot 9. <br />Any expansion, modification beyond typical maintenance, or new construction of either <br />structure must meet zoning district setbacks and may not encroach easements. <br />3. The applicant must obtain all other necessary City, State, and other governing body <br />permits prior to release of the lot division for recording with the County. <br />4. The driveway segment and curb cut removal shall be completed prior to release of the lot <br />division for recording with the County. <br />5. The address 10997 32nd Street North shall be assigned to Lot 9. <br />6. The Applicant shall work with the City and County to assign a new address to Lot 10. <br />7. Building address numbers shall be plainly visible from the street fronting the property <br />and shall contrasting color from the background. <br />OPTIONS! <br />
