21 <br />LA515\135\943139.v2 <br />1. The Developer must enter into a preliminary plat extension agreement in the City’s <br />standard form. <br />2. The Developer must enter into a landscape license and maintenance agreement with the <br />City that clarifies the individuals or entities responsible for landscaping within the <br />Subdivision. <br />3. All changes and modifications to the plans requested by the City Engineer in the <br />Memorandum dated March 6, 2024 must be incorporated by the Developer into the Final <br />Plat and PUD Plans to the satisfaction of the City Engineer. <br />4. All changes and modifications to the plans requested by the City’s Landscape Architect in <br />the Memorandum dated March 5, 2024 must be incorporated by the Developer into the <br />Final Plat and PUD Plans to the satisfaction of the Landscape Architect. <br />5. That the Final Plat must include street names as approved by Council. <br />6. The Developer must follow all the rules and regulations spelled out in the Wetland <br />Conservation Act and shall acquire the needed permits from the appropriate watershed <br />districts prior to the commencement of any grading or development activity within the <br />Subdivision. <br />7. The Developer shall provide a warranty deed conveying the four outlots within 5th Addition <br />(Outlots B, F, G, and H) to the City. <br />8. All property within the Subdivision must be incorporated by the Developer into the <br />declaration concerning management of the common areas and establish a homeowner’s <br />association. The amendment to the declaration must be submitted in final form to the City <br />before any building permit may be issued for any structure in the Subdivision. The <br />declaration must require maintenance by the homeowners’ association of all wetland <br />buffers within the Subdivision. <br />9. All requirements stated in the Fire Department’s memorandum dated February 24, 2024 <br />must be met.
