1 <br /> <br /> <br /> STAFF REPORT <br /> DATE: 5/7/2024 <br /> REGULAR <br /> <br />TO: City Council <br />FROM: Sophia Jensen, City Planner <br /> Nathan Fuerst, AICP, Consulting Planner <br />AGENDA ITEM: Public Hearing - Birth and Haven Proposal – Comprehensive Plan and <br />Zoning Text Amendments <br />REVIEWED BY: Jason Stopa, Community Development Director <br />Jenni Faulkner, Senior Consulting Planner <br /> <br /> <br />BACKGROUND: <br />Minnesota Women’s Care, PLLC (the “Applicant”), has purchased three contiguous parcels north <br />of Clear Lake with the intent to establish a birth center and postpartum care center on the property. <br />The property is directly accessed off Keats Ave. N. In total, the site area is just over 60 acres with <br />around 10 acres below the OHWL of Clear Lake. <br /> <br />After the purchase of the property, the Applicant contacted the City to communicate plans for <br />improvements on the property and to ask questions about the establishment of the proposed land <br />use. Staff identified a need to amend the City’s Code, which broadly defines medical uses, in <br />addition to amending the Agricultural district to allow the proposed uses. <br /> <br />Two requests are being processed concurrently by the City at this time: <br />• Comprehensive Plan Amendment – Remove the property’s designation as Agricultural <br />Preserve (AP), and reguide the parcels to Rural Area Development (RAD). <br />• Zoning Text Amendment – Amend the Agricultural (A) zoning district to permit the uses <br />proposed by Minnesota Women’s Care. <br /> <br />If the proposed comprehensive plan and zoning text amendments are approved, the Applicant <br />would then need to apply for a conditional use permit, which would require a public hearing and <br />review by the Planning Commission and City Council. At that time, the City may add conditions it <br />feels are necessary to mitigate concerns. The Applicant would also be required to go through any <br />additional licensing required by the State of Minnesota or Washington County. <br /> <br />ISSUE BEFORE THE CITY COUNCIL: <br />The City Council is being asked to make a determination on the proposed Comprehensive Plan <br />Map and Zoning Text Amendments. <br /> <br />GENERAL INFORMATION: <br />Applicant: Melvin Ashford, Minnesota Women’s Care <br />Property Owner: Minnesota OBGYN, PLLC <br />Address: 5193 Keats Ave N
