traffic on the level of service of nearby and adjacent streets, <br />intersections, and total parking requirements; <br />k. A plan sheet or narrative clearly delineating all features being modified <br />from standard open space PUD regulations; <br />l. Homeowners’ association documents including declarations, <br />covenants, articles of incorporation, and bylaws; <br />m. Proposed conservation easement documents; and <br />n. Any other information as directed by the director of planning <br />community development director. <br />3. PUD preliminary plan review. <br />a. As part of the review process for an open space PUD preliminary plan, <br />the director of planning community development director shall <br />generate an analysis of the proposal against the expectations for PUDs, <br />and make a recommendation regarding the proposed overlay district <br />for planning commission and city council consideration. <br />b. The director of planning community development director shall <br />prepare a draft ordinance to establish the potential overlay district to <br />be established as a component of the PUD final plan. <br />c. The planning commission shall hold a public hearing and consider the <br />application's consistency with the goals for PUDs, the PUD review <br />criteria, and applicable comprehensive plan goals. The planning <br />commission shall make recommendations to the city council on the <br />merit, needed changes, and suggested conditions to impose on the PUD. <br />d. In approving or denying the PUD preliminary plan, the city council <br />shall make findings on the PUD review criteria outlined in LEC <br />105.12.1070. <br />e. As a condition of PUD preliminary plan approval; finalization, adoption, <br />and publication of an overlay district ordinance shall need to occur <br />prior to the filing of any future final plat. <br />4. Effect of a PUD preliminary plan review. Preliminary plan approval governs <br />the preparation of the PUD final plan which must be submitted for final <br />approval in accordance with the requirements of this section. <br />5. Limitation of approval. The city council's review of an open space PUD <br />preliminary plan shall remain valid for a period of one year. The city council, <br />in its sole discretion, may extend the validity of its findings for an additional <br />year. <br />B. PUD final plan. <br />1. Application deadline. Application for an open space PUD final plan shall be <br />submitted for approval within 180 days of city council approval of the open <br />space PUD preliminary plan unless a written request for a time extension is <br />submitted by the applicant and approved by the city council. <br />2.
