The applicant shall obtain approval from the City of Lake Elmo Engineer for the proposed increase in peak stormwater <br />runoff rates to the storm sewer in 39th St. N. east of Wildflower Drive. <br />2. Updated plans shall be submitted to the VBWD Engineer for approval with a note or detail to state that if soils that are not <br />conducive to infiltration are discovered within the infiltration basin during construction, these soils need to be removed <br />and replaced with soil material that will infiltrate at the design rate. The permit is not valid until the VBWD Engineer has <br />approved the submittal. <br />3. This permit is not valid until a maintenance agreement in the general format of Appendix A of the VBWD Rules is submitted <br />to and approved by the VBWD Attorney. The maintenance agreement must include a monitoring plan and details on <br />maintaining the stormwater management facility. <br />4. Prior to permit closeout, a plan for post-project management of chloride use shall be submitted. At a minimum, the plan <br />shall include the following: <br />a. Designation of an individual authorized to implement the chloride-use plan <br />b. Designation of an MPCA-certified salt applicator to implement the chloride-use plan for the site <br />5. Updated plans shall be submitted to the VBWD Engineer for approval to revise the discharge elevation of FES-300 to be at <br />the bottom of the infiltration basin rather than up the slope to mitigate potential erosion issues. The permit is not valid <br />until the VBWD Engineer has approved the submittal. <br />6. The permit holder shall contact the VBWD Wetland Biologist (Karen Wold, 952-832-2707) prior to the commencement of <br />any construction to schedule a field visit to determine if any temporary or permanent wetland impacts will occur. If <br />wetland impacts will occur, the owner shall submit the required documents and work with the VBWD to prepare and follow <br />restoration plans. <br />7. The required surety shall be submitted prior to construction. <br />8. The applicant must obtain any necessary approvals from other persons and/or entities with ownership interests in the <br />property affected by the proposed project. It is the applicant’s burden to obtain any and all necessary permissions or <br />ownership rights to property not owned by the applicant, including prescriptive easements. The applicant must obtain any <br />necessary permits. <br />9. This permit is not transferable. <br />10. The applicant agrees to indemnify and hold harmless the VBWD for any and all future liability, causes of action, or claims <br />relating to or arising out of the District’s grant of this permit. Such claims include, but are not limited to, onsite flooding <br />and flooding to neighboring properties. <br />11. This permit is subject to obtaining all other permits required by governmental agencies having jurisdiction (including an <br />NPDES permit). <br />12. The VBWD Engineer and Inspector shall be notified at least 3 days prior to commencement of work. <br />13. Erosion controls shall be installed prior to the commencement of grading operations and must be maintained throughout <br />the construction period until turf is established. Additional erosion controls may be required, as directed by the VBWD <br />Inspector or VBWD Engineer. <br />14. All disturbed areas shall be vegetated within 7 days of final grading. <br />15. The applicant is responsible for removal of all temporary erosion-control measures, including silt fence, upon establishment <br />of permanent vegetation at the project site, as determined by the VBWD Engineer and/or Inspector. <br />16. To prevent soil compaction, the proposed infiltration areas shall be staked off and marked during construction to prevent <br />heavy equipment and traffic from traveling over them. If infiltration facilities are in place during construction activities, <br />sediment and runoff shall be kept away from the facility using practices such as diversion berms and vegetation around the <br />facility’s perimeter. Infiltration facilities shall not be excavated to final grade until the contributing drainage area has been <br />constructed and fully stabilized. The final excavation phase shall remove all accumulated sediment and be done by light, <br />tracked equipment to avoid compaction of the basin floor. To provide a well-aerated, highly porous surface, the soils of the <br />basin floor shall be loosened to a depth of at least 5 feet to a maximum compaction of 85% standard proctor density prior <br />to planting. The upper 10 inches of soil shall be tilled prior to planting. <br />17. Valley Branch Watershed District shall be granted drainage easements that cover land adjacent to stormwater management <br />facilities, wetlands, lakes, and lowlands up to their 100-year flood elevations and all ditches, storm sewers, and <br />maintenance access to the stormwater management facilities. <br />18. The required drainage and access easements shall be recorded with the Washington County Recorder’s Office. <br />19. Return or allowed expiration of any remaining surety and permit closeout is dependent on the permit holder providing <br />proof that all required documents have been recorded (including but not limited to easements) and providing as-built <br />drawings that show that the project was constructed as approved by the Managers and in conformance with the VBWD <br />Rules and Regulations. <br />20.
