STAFF REPORT <br />DATE: June 18, 2024 <br /> CONSENT <br /> <br />AGENDA ITEM: Approve Limited Use Permit No. 8282-0091 with the Minnesota <br />Department of Transportation <br /> <br />SUBMITTED BY: Jack Griffin, City Engineer <br />REVIEWED BY: Nicole Miller, City Administrator <br /> Sarah Sonsalla, City Attorney Marty Powers, Public Works Director <br /> Chad Isakson, Assistant City Engineer <br /> <br /> <br />ISSUE BEFORE COUNCIL: Should the City Council approve Limited Use Permit No. 8282-0091 with <br />the Minnesota Department of Transportation? <br /> <br />BACKGROUND: As part of the 2024 Street Capital Improvement Program, the City is making <br />improvements along Hudson Boulevard North, from Inwood Avenue (CSAH 13) to approximately 1,400 <br />feet east of Jade Trail, including the construction of a new bituminous trail along the north boulevard. In <br />order to connect the new trail to the pedestrian ramp at the intersection of Inwood Avenue (CSAH 13) and <br />Hudson Boulevard, a portion of the new trail will be constructed within the right-of-way of Trunk Highway <br />No. 94 (see attached exhibit in the Limited Use Permit). <br /> <br />PROPOSAL DETAILS/ANALYSIS: To accommodate the City trail to be constructed within the right- <br />of-way of Trunk Highway No. 94, the Minnesota Department of Transportation requires the City to enter <br />into a limited use permit to provide for the maintenance and use of the tail by the City, and has prepared <br />the Limited Use Permit No. 8282-0091 accordingly. The LUP has been reviewed by the City Attorney and <br />includes the following provisions: <br /> <br />1. The trail must be for nonmotorized vehicles. <br />2. The limited use permit expires on June 3, 2034. However, the City may renew it for an additional 10- <br />year term as long as it provides notice within 90 days of the limited use permit expiring. <br />3. Once the limited use permit expires, the City is responsible for removing the trail and restoring the area. <br />4. The City is responsible for snow removal and maintenance of the trail. The City must ensure that the <br />trail is in compliance with the ADA. <br /> <br />FISCAL IMPACT: Not applicable. <br /> <br />RECOMMENDATION: Staff is recommending that the City Council approve, as part of the consent <br />agenda, a Resolution approving a Limited Use Permit with Minnesota Department of Transportation for <br />trail maintenance along and adjacent to Trunk Highway 94. If removed from the consent agenda, the <br />recommended motion for the action is as follows: <br /> <br />“Move to approve Resolution No. 2024-079, Approving Limited Use Permit No. 8282-0911 with the <br />Minnesota Department of Transportation.” <br /> <br />ATTACHMENTS: <br /> <br />1.
