<br />16 <br />LA515\129\891453.v6 <br />26. SPECIAL PROVISIONS. The following special provisions shall apply to the Subdivision <br />and include the Conditions of Approval of the Final Plat and Final PUD Plans: <br /> A. That publication of the PUD ordinance shall be required before the recording of the <br />approved final plat. <br /> B. All issues set forth in the City Attorney’s plat opinion letter dated May 24, 2023 must <br />be addressed to the satisfaction of the City Attorney prior to the recording of the final <br />plat. <br /> C. All issues set forth in the City Engineer’s Final Plat and Final Construction Plan review <br />memos dated July 12, 2023 must be addressed to the satisfaction of the City Engineer <br />prior to the recording of the Final Plat. <br /> C. All outlots to be deeded to the City shall be provided in a form acceptable to the City <br />by the Developer and recorded with the final plat. <br /> D. If desired, the Developer shall incorporate stormwater reuse for irrigation as approved <br />by the City Engineer. <br /> E. If applicable, the Developer shall provide the City with a copy of written permission <br />from adjacent property owners for any off-site grading work or storm sewer discharges <br />to adjacent properties before starting any work on the Property. <br />F. Before the installation or construction of any subdivision identification signs or <br />neighborhood markers within the Subdivision, the Developer shall submit sign plans <br />to the City for review and obtain a sign permit from the City. <br />G. The Developer shall enter into a Stormwater Maintenance and Easement Agreement <br />in the City’s standard form with the City. <br />27. MISCELLANEOUS. <br /> <br />A. The Developer may not assign this Agreement without the written permission of the <br />City Council. The Developer's obligations hereunder shall continue in full force and
