CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2024-123 <br />A RESOLUTIONAPPROVING THE SECOND AMENDMENT TO THE DEVELOPMENT <br />AGREEMENT FOR EASTON VILLAGE 6THAND 7THADDITIONS <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Chase Development, Inc (the "Applicant") has previously submitted an <br />application to the City of Lake Elmo (the "City") for a final plat for Easton Village 7th Addition; <br />and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2022-118 on December <br />13t112022 approving the final plat for Easton Village 7' Addition; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2024-033 on March 191h <br />2024 approving the Development Agreement for Easton Village 6t1 and 711 Additions; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2024-080 on July 2" d <br />2024 approving the first amendment to the Development Agreement for Easton Village 61h and 7"' <br />Additions to allow a building permit to be obtained for Lot 1, Block 1, Easton Village 61h Addition <br />prior to completing the subdivision improvements in Easton Village 71h Addition; and <br />WHEREAS, the Applicant and the City have agreed to amend the Development <br />Agreement for Easton Village 61h and 7th Additions a second time in order to allow building permits <br />to be issued prior to public improvement acceptance by the City and prior to the installation of <br />sidewalks for Easton Village 71h Addition; and <br />NOW, THEREFORE, based on the information received, the City Council of the City of <br />Lake Elmo does hereby approve the Second Amendment to Development Agreement for Easton <br />Village 6"' and 71h Addition, authorize the City Attorney to draft the Second Amendment to the <br />Development Agreement to include provisions to allow building permits to be issued prior to <br />acceptance of public improvements consistent with the language in the Northstar 1 st Addition and <br />Easton Village 5th Addition Development Agreements, and authorize the Mayor and City Clerk <br />to execute the Second Amendment to Development Agreement. <br />LA515\89\988420.vl <br />
