Approve Release of Warranty Security for Legacy at Northstar 1" Addition <br />17. Accept Improvements and Approve Pay Request No. 1 for the 2024 Striping Project <br />18. Accept Improvements and Approve Pay Request No. 9 for Torre Pines Street & Utility <br />Improvements <br />19. Accept Improvements and Approve Pay Request No. 12 for Whistling Valley Street and <br />Utility Improvement <br />Councilmember Holtz, seconded by Councilmember Dragisich, moved TO APPROVE THE <br />CONSENT AGENDA AS PRESENTED. Motion passed 4 - 0. <br />ITEM 20: Lake Elmo Elementary — CUP, Variance and Preliminary Plat <br />Contract Planner Nathan Fuerst presented requests from the Stillwater Area Public Schools for a <br />conditional use permit, variance and preliminary plat approval to allow construction of a new elementary <br />school. Discussion was held regarding trees, irrigation, and traffic/access to the site. Planner Fuerst <br />reviewed the proposed conditions of approval. <br />Brian Johnson, 10841 100' Street N., expressed concern over tree removal and screening from 100' Street, <br />and increased traffic. <br />Mark Drommerhausen , Stillwater Area Schools Director of Operations, explained why the site in Lake <br />Elmo was chosen. <br />Additional discussion held regarding noise mitigation and trees. <br />Councilmember Holtz, seconded by Councilmember Dragisich, moved TO ADOPT <br />RESOL UTION 2 024-114 APPRO VING THE VARIANCES REQ UESTED FOR LAKE ELMO <br />ELEMENTARY AS PROPOSED BY STILLWATER AREA PUBLIC SCHOOLS, ISD 834, <br />WITH THE CONDITIONS AND FINDINGS LISTED IN THE STAFF REPORT. Motion <br />passed 4 — 0. <br />Councilmember Holtz, seconded by Councilmember Dragisich, moved TO ADOPT <br />RESOLUTION 2024-115 APPROVING THE PRELIMINARY PLAT REQUESTED FOR <br />LAKE ELMO ELEMENTARY AS PROPOSED BY STILLWATER AREA PUBLIC <br />SCHOOLS, ISD 834, WITH THE CONDITIONS AND FINDINGS LISTED IN THE STAFF <br />REPORT.
