STAFF REPORT <br />DATE: 11/19/24 <br />Consent Agenda <br /> <br /> <br /> <br /> <br /> <br />TO: Lake Elmo City Council <br />FROM: Nathan Fuerst, AICP, Consulting Planner <br />AGENDA ITEM: Roers Companies - Final Plat and PUD for Roers Lake Elmo Apartments <br />REVIEWED BY: Jason Stopa, Community Development Director <br /> <br /> <br />BACKGROUND: <br />The City Council adopted Resolution 2022-103 approving the DPS Lake Elmo 3rd Addition final <br />plat on November 1, 2022. The Subdivision Ordinance and resolution requires the subdivider to <br />record the final plat within 180 days of approval or the plat becomes void. Resolution 2023-068 <br />granted an extension to record until August 1, 2023. <br /> <br />On June 18, 2024, the Lake Elmo City Council approved a second extension to the final plat <br />recording date, to allow an extension of the deadline to August 1, 2025. <br /> <br />Since initial approval of the final plat and Development Agreement, the developer SRD 2.0 LLC <br />(Shafer Richardson) decided not to move ahead with the project. In the time since, Roers <br />Companies, a Minnesota based national developer, has acquired the project from the former <br />developer. <br /> <br />Roers Companies was required to make a Final Plat and PUD application for the following reasons: <br />• Final Plat and Construction plans required final revisions to conform with the City’s prior <br />approvals. It has been two years since the prior approval, and minor elements on the final <br />plat have changed. <br />• Since approval of the PUD, the City Council has revised Lake Elmo City Code to require <br />adoption of a PUD Ordinance. A draft ordinance is attached which includes only the <br />approvals previously granted by the City. <br /> <br />ISSUE BEFORE THE COUNCIL: <br />Does the final plat meet the prior approvals? If so the Final Plat and PUD should be approved. <br /> <br />GENERAL INFORMATION: <br />Applicant: Roers Companies, LLC., 2 Carlson Parkway #400, Plymouth, MN <br />Property Owner: DPS-Lake Elmo LLC, 6007 Culligan Way, Minnetonka, MN <br />Deadline: Application Complete – 9/27/2024 <br /> 60 Day Deadline – 11/26/24
