STAFF REPORT DATE: 11/19/24 Consent Agenda TO: Lake Elmo City Council FROM: Nathan Fuerst, AICP, Consulting Planner AGENDA ITEM: Roers Companies - Final Plat and PUD for Roers Lake Elmo Apartments REVIEWED BY: Jason Stopa, Community Development Director BACKGROUND: The City Council adopted Resolution 2022-103 approving the DPS Lake Elmo 3rd Addition final plat on November 1, 2022. The Subdivision Ordinance and resolution requires the subdivider to record the final plat within 180 days of approval or the plat becomes void. Resolution 2023-068 granted an extension to record until August 1, 2023. On June 18, 2024, the Lake Elmo City Council approved a second extension to the final plat recording date, to allow an extension of the deadline to August 1, 2025. Since initial approval of the final plat and Development Agreement, the developer SRD 2.0 LLC (Shafer Richardson) decided not to move ahead with the project. In the time since, Roers Companies, a Minnesota based national developer, has acquired the project from the former developer. Roers Companies was required to make a Final Plat and PUD application for the following reasons: • Final Plat and Construction plans required final revisions to conform with the City’s prior approvals. It has been two years since the prior approval, and minor elements on the final plat have changed. • Since approval of the PUD, the City Council has revised Lake Elmo City Code to require adoption of a PUD Ordinance. A draft ordinance is attached which includes only the approvals previously granted by the City. ISSUE BEFORE THE COUNCIL: Does the final plat meet the prior approvals? If so the Final Plat and PUD should be approved.
