STAFF REPORT
DATE: August 19, 2025
CONSENT
ITEM #:

TO: City Council
From: John Taylor, Lake Elmo Building Official
AGENDA ITEM: MNSPECT (SAFEbuilt Subsidiary) Contract Amendment
REVIEWED BY: Jason Stopa, Lake Elmo Community Development Director
Dustin Kalis, Lake Elmo Fire Chief, Sara J. Sonsalla, Lake Elmo Attorney

BACKGROUND:
Staff recommends amending the current contract with MNSPECT (SAFEbuilt subsidiary) from 2019 to
reflect changes to their services and when those services will be requested and used. This amended contract
will note when the Minnesota Department of Labor and Industry (DOLI) will be notified when there are
changes needed for the Letter of Understanding (LOU) with the City of Lake Elmo for State Projects Plan
Reviews and Inspections.

ISSUE BEFORE COUNCIL:
Should the City Council approve the amended Contract with SAFEbuilt as submitted?

PROPOSAL DETAILS/ANALYSIS:
The City of Lake Elmo Building Department on occasion needs outside plan reviews or extra inspectors
for General Projects and those that are defined as State Projects by the MN Department of Labor. This
would provide a clear and better understanding of when those services are to be requested and needed/used.
With this approval the City would be in compliance with MN Department of Labor rules.

The Lake Elmo Fire has state delegation for fire alarm and fire sprinkler plan reviews and inspections. This
amended contract clarifies language related to this delegation.

FISCAL IMPACT:
No changes in fees associated with their services. The City of Lake Elmo Fire Department has
been conducting these plans reviews and inspections for some years now. This is to update
language that will help with keeping the LOU current in the future.

OPTIONS:
- Approve the Contract Amendment as written
- Approve the Contract Amendment with comments
- Do not approve the Contract Agreement as written
