The project shall conform to the VBWD’s stormwater runoff rate and volume control rule throughout construction. <br />2. Appendix G of the AE2S January 9, 2023, Stormwater Management Plan lists the minimum pervious areas that will be used for <br />irrigation to conform to VBWD rules. These areas shall be recorded at the Washington County Recorder’s office, so they are <br />preserved. Impervious surfaces greater than those listed in Appendix G will be prohibited. <br />3. The pond liner specification (Sheet GP1) shall be revised to be consistent with the specification in the Minnesota Stormwater <br />Manual: https://stormwater.pca.state.mn.us/index.php?title=Liners_for_stormwater_management. <br />4. This permit is not valid until a maintenance agreement in the general format of Appendix B of the VBWD Rules is submitted to <br />and approved by the VBWD Attorney. <br />5. Any drain tile adjacent to Wetland A shall not be lower than Elevation 949.7, and inlets shall be no lower than 950.2. <br />6. The plans shall be revised to list the 100-year high water levels of Ponds 3N1 and 3N2 at Elevation 934.3. <br />7. The required surety shall be submitted prior to construction. <br />8. Approval of this permit does not constitute approval of revisions to Permit 2018-08, Legacy at Northstar. <br />9. The VBWD recognizes that the proposed development’s management of stormwater runoff for volume and rate control <br />includes an assumption that 5.4 acres of new impervious surface area will be created with a reconstructed Stillwater <br />Boulevard (CSAH 14)-Lake Elmo Avenue (CSAH 17) intersection adjacent to the site. The VBWD will allow the excess capacity <br />to be used for the future intersection reconstruction project, as approved by Washington County, the City of Lake Elmo, and <br />VBWD. <br />10. The applicant must obtain any necessary approvals from other persons and/or entities with ownership interests in the <br />property affected by the proposed project. It is the applicant’s burden to obtain any and all necessary permissions or <br />ownership rights to property not owned by the applicant, including prescriptive easements. The applicant must obtain any <br />necessary permits. <br />11. This permit is not transferable. <br />12. The applicant agrees to indemnify and hold harmless the VBWD for any and all future liability, causes of action, or claims <br />relating to or arising out of the District’s grant of this permit. Such claims include, but are not limited to, onsite flooding and <br />flooding to neighboring properties. <br />13. This permit is subject to obtaining all other permits required by governmental agencies having jurisdiction (including an <br />NPDES permit). <br />14. The VBWD Engineer and Inspector shall be notified at least 3 days prior to commencement of work. <br />15. Erosion controls shall be installed prior to the commencement of grading operations and must be maintained throughout the <br />construction period until turf is established. Additional erosion controls may be required, as directed by the VBWD Inspector <br />or VBWD Engineer. <br />16. All disturbed areas shall be vegetated within 7 days of final grading. <br />17. The applicant is responsible for removal of all temporary erosion-control measures, including silt fence, upon establishment <br />of permanent vegetation at the project site, as determined by the VBWD Engineer and/or Inspector. <br />18. Valley Branch Watershed District shall be granted drainage easements that cover land adjacent to stormwater management <br />facilities, wetlands, lakes, and lowlands up to their 100-year flood elevations and all ditches, storm sewers, and maintenance <br />access to the stormwater management facilities. Valley Branch Watershed District shall also be granted drainage easements <br />that cover all land used for stormwater management to meet the District’s rules; this includes land irrigated by stormwater, <br />unless the VBWD Attorney approves another mechanism (e.g., Declaration of Covenants) for preserving land irrigated by <br />stormwater. If the VBWD Attorney approves a mechanism other than drainage easements for preserving land irrigated by <br />stormwater, the Managers shall approve of the mechanism prior to execution. <br />19. The required drainage easements and access easements shall be recorded with the Washington County Recorder’s Office. <br />20. The minimum floor elevations for all buildable lots in the development shall be recorded in a Declaration of Covenants and <br />Restrictions or on the final plat. <br />21. Return or allowed expiration of any remaining surety and permit closeout is dependent on the permit holder providing proof <br />that all required documents have been recorded (including but not limited to easements) and providing as-built drawings that <br />show that the project was constructed as approved by the Managers and in conformance with the VBWD Rules and <br />Regulations. <br />22.
