1. The VBWD recognizes that the proposed development’s management of stormwater runoff for volume and rate <br />control includes an assumption that 7.42 acres of new impervious surface area will be created with improvements <br />to Lake Elmo Avenue North (County Road 17) and 10th Street North (County Road 10) adjacent to the site. The <br />VBWD will allow the excess capacity to be used for the future reconstruction projects, as approved by Washington <br />County, the City of Lake Elmo, and VBWD. <br />2. This permit is not valid until a maintenance agreement in the general format of Appendix A of the VBWD Rules is <br />submitted to and approved by the VBWD Attorney. <br />3. Prior to permit closeout, a plan for post‐project management of chloride use shall be submitted. At a minimum, <br />the plan shall include the following: <br />a. Designation of an individual authorized to implement the chloride‐use plan <br />b. Designation of an MPCA‐certified salt applicator to implement the chloride‐use plan for the site <br />4. The required surety shall be submitted prior to construction. <br />5. The applicant must obtain any necessary approvals from other persons and/or entities with ownership interests in <br />the property affected by the proposed project. It is the applicant’s burden to obtain any and all necessary <br />permissions or ownership rights to property not owned by the applicant, including prescriptive easements. The <br />applicant must obtain any necessary permits. <br />6. This permit is not transferable. <br />7. The applicant agrees to indemnify and hold harmless the VBWD for any and all future liability, causes of action, or <br />claims relating to or arising out of the District’s grant of this permit. Such claims include, but are not limited to, <br />onsite flooding and flooding to neighboring properties. <br />8. This permit is subject to obtaining all other permits required by governmental agencies having jurisdiction <br />(including an NPDES permit). <br />9. The VBWD Engineer and Inspector shall be notified at least 3 days prior to commencement of work. <br />10. Erosion and sediment controls shall be installed prior to the commencement of grading operations and must be <br />maintained throughout the construction period until turf is established. Additional controls may be required, as <br />directed by the VBWD Inspector or VBWD Engineer. <br />11. All disturbed areas shall be vegetated within 7 days of final grading. <br />12. The applicant is responsible for removal of all temporary erosion‐control measures, including silt fence, upon <br />establishment of permanent vegetation at the project site, as determined by the VBWD Engineer and/or <br />Inspector. <br />13. To prevent soil compaction, the proposed infiltration areas shall be staked off and marked during construction to <br />prevent heavy equipment and traffic from traveling over them. If infiltration facilities are in place during <br />construction activities, sediment and runoff shall be kept away from the facility using practices such as diversion <br />berms and vegetation around the facility’s perimeter. Infiltration facilities shall not be excavated to final grade <br />until the contributing drainage area has been constructed and fully stabilized. The final excavation phase shall <br />remove all accumulated sediment and be done by light, tracked equipment to avoid compaction of the basin <br />floor. To provide a well‐aerated, highly porous surface, the soils of the basin floor shall be loosened to a depth of <br />at least 5 feet to a maximum compaction of 85% standard proctor density prior to planting. The upper 10 inches <br />of soil shall be tilled prior to planting. <br />14. Valley Branch Watershed District shall be granted drainage easements that cover land adjacent to stormwater <br />management facilities, wetlands, lakes, and lowlands up to their 100‐year flood elevations and all ditches, storm <br />sewers, and maintenance access to the stormwater management facilities. <br />15. The required drainage and access easements shall be recorded with the Washington County Recorder’s Office. <br />16. Return or allowed expiration of any remaining surety and permit closeout is dependent on the permit holder <br />providing proof that all required documents have been recorded (including but not limited to easements) and <br />providing as‐built drawings that show that the project was constructed as approved by the Managers and in <br />conformance with the VBWD Rules and Regulations. <br />17.
