<br />6 <br />LA515\147\1015204.v1 <br />LA515\147\1015204.v1 <br />compliance with the Plans, the City approvals, the City Code, and the applicable City Standards. <br />The Developer will notify the City at such times during construction as the City requires for <br />inspection purposes. Such inspection is pursuant to the City’s governmental authority, and no <br />agency or joint venture relationship between the City and the Developer is thereby created. <br />8. CONTRACTORS/SUBCONTRACTORS. City Council members, City employees, <br />and City Planning Commission members, and corporations, partnerships, and other entities in <br />which such individuals have greater than a 25 percent ownership interest or in which they are an <br />officer or director may not act as contractors or subcontractors for the Subdivision Improvements <br />identified in paragraph 6 above. <br />9. TIME OF PERFORMANCE. The Developer shall install all required Subdivision <br />Improvements by October 31, 2026. The Developer may, however, request an extension of time <br />from the City. If the City grants an extension, it shall be conditioned upon updating the Security <br />posted by the Developer to reflect cost increases and amending this Agreement if necessary to <br />reflect the extended completion date. Final wear course placement outside of this time frame <br />must have the written approval of the City Engineer. <br />10. MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for <br />all maintenance of the Subdivision Improvements until the Subdivision Improvements are <br />accepted by the City in writing. The Developer also is responsible to locate all underground <br />utilities until the Subdivision is accepted in writing by the City. Warning signs shall be placed by <br />the Developer when hazards develop in streets to prevent the public from traveling on same and <br />to direct attention to detours. If and when streets become impassable, such streets shall be <br />barricaded and closed by the Developer. The Developer shall maintain a smooth surface and <br />provide proper surface drainage to ensure that the access roads are passable for emergency <br />vehicles. The Developer shall be responsible for keeping streets within and around the <br />Subdivision clean and clear of dirt and debris that may spill, track, or wash onto the street from
