7 <br />LA515\150\1011808.v2 <br />agency or joint venture relationship between the City and the Developer is thereby created. <br />10. CONTRACTORS/SUBCONTRACTORS. City Council members, City employees, <br />and City Planning Commission members, and corporations, partnerships, and other entities in <br />which such individuals have greater than a 25 percent ownership interest or in which they are an <br />officer or director may not act as contractors or subcontractors for the Subdivision Improvements <br />identified in Paragraph 8 above. <br />11. TIME OF PERFORMANCE. The Developer shall install all required Subdivision <br />Improvements by October 31, 2026, with the exception of the final wear course of asphalt on <br />streets. The Developer shall install the bituminous wearing course of streets after the first course <br />has weathered a winter season, consistent with warranty requirements, however, final acceptance <br />of the Subdivision Improvements by the City will not be granted until all work is completed, <br />including the final wear course. The Developer may, however, request an extension of time from <br />the City. If the City grants an extension, it shall be conditioned upon updating the Security posted <br />by the Developer to reflect cost increases and amending this Agreement if necessary to reflect <br />the extended completion date. Final wear course placement outside of this time frame must have <br />the written approval of the City Engineer. <br />12. MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for <br />all maintenance of the Subdivision Improvements including the snow plowing of the streets, roads, <br />alleys, and sidewalks abutting lots not yet sold or transferred, until the Subdivision Improvements <br />are accepted by the City in writing. The Developer and its contractors must adhere to the City’s <br />weight restrictions for all streets both inside and outside of the Subdivision, regardless of whether <br />said streets are included in the City’s map of streets with weight restrictions and regardless of <br />whether said streets are fully constructed. The Developer also is responsible to locate all <br />underground utilities until the Subdivision is accepted in writing by the City. Warning signs shall <br />be placed by the Developer when hazards develop in streets to prevent the public from traveling
