3 <br />LA515\150\1011808.v2 <br />City Engineering Administration Escrow required by this Agreement; <br />H. the Developer has entered into a Landscape License Agreement with the City in the <br />City’s standard form that clarifies the individuals or entities responsible for maintenance <br />of any landscaping installed in areas outside of land dedicated as public park and open <br />space on the final plat; <br />I. the Developer shall provide the City with a copy, and list the City as a beneficiary, in any <br />temporary construction and permanent easements from adjacent or nearby properties <br />necessary to construct the Subdivision Improvements, including all off-site public <br />improvements, off-site grading work, or storm sewer discharges; <br />J. the Developer has provided the City with a certificate of insurance required by this <br />Agreement, Section 29.E; <br />K. the Developer has received all necessary permits from the MPCA, MDH, DNR, MnDOT, <br />the applicable watershed, Washington County, and any other agency having jurisdiction <br />over the Subdivision; <br />L. the Developer has installed tree protection fencing or additional measures per approved <br />Tree Preservation Plan and the City has inspected and approved the protections; <br />M. the final plat has been recorded with Washington County; and <br />N. the Developer or the Developer’s engineer and the Developer’s contractor(s) have <br />initiated and attended a preconstruction meeting with the City Engineer and City staff; <br />and <br />O. the City has issued a written notice that all above conditions have been satisfied and that <br />the Developer may proceed. <br />4. PHASED DEVELOPMENT. The Subdivision is the second phase of a multi-phased <br />development known as North Star (the “Development”). The City may refuse to approve final plats <br />of subsequent phases of the Development if the Developer is not in compliance with any term of
