Existing Land Use: Vacant <br />Existing Zoning: Commercial <br />Surrounding: North: Village Medium Density Residential Stormwater Pond (V-MDR) <br />South: Stillwater Blvd and Rural Transitional (RT) <br />East: Commercial (C) <br />West: Village Medium Density Residential Stormwater Pond (V-MDR) <br />Comprehensive Plan: Commercial <br />Deadline for Action: Application Complete – 4/14/2025 <br />60 Day Deadline – 6/16/2025 <br />Regulations: Chapter 105.12 Zoning Code <br />ARTICLE XV Commercial Districts <br />ISSUE BEFORE CITY COUNCIL: <br />The City Council is being asked to review and make a motion on the request for a conditional <br />use permit for Primrose School. <br />REVIEW COMMENTS <br />This request was distributed to several departments and agencies for review on April 11th, 2025. <br />The following departments provided comments on the applications. Conditions of approval have <br />been added where applicable: <br />•MN DNR- No comment provided. <br />•WA County – Comment Letter dated 4/25/2025 <br />•VBWD – Provided comments that VBWD permit is in process. <br />•MACMSP - 5/1/25 Provided comments that no permits were required and provided FAA <br />guidance <br />•Fire Dept- Provided a memo dated 4/23/25 noting their standard comments regarding <br />drive lanes, parking, fire suppression, lock boxes, and fire alarms. <br />•Landscape Architect- Provided a memo dated 4/23/2025 requesting plan revisions on the <br />landscape plan around meeting parking lot landscaping and additional trees. <br />•City Engineer– Provided a memo dated 4/23/2025 summarizing that while the plans <br />submitted with the application are substantially compliant with the intended Bridgewater <br />Village infrastructure improvements, Civil Site Plans may be revised which will require <br />review and approval by the City once the Bridgewater Village Subdivision Improvements <br />have been constructed and accepted. <br />•Planning Department – 5/7/25 Provided memo requesting minor revisions to plans and <br />noting sign and fence permitting requirements. <br />•Public Works – 4/28/25, Provided comments regarding encroachment agreemnents for <br />any improvements in drainage and utility easements <br />RECCOMMENDED FINDINGS: <br />LEC 105.12.290 has twelve required findings that conditional use permits must meet before they <br />are reviewed for approval. Staff has determined compliance with the following criteria: <br />1. The proposed use will not be detrimental to or endanger the public health, safety, <br />comfort, convenience or general welfare of the neighborhood or the city. <br />2. The use or development conforms to the city comprehensive plan.
