Ms. Sophia Jensen <br />April 29, 2025 <br />Page 3 <br /> <br />a radius of 1,145.92 feet and a central angle of 18°45’59” a distance of 375.33 feet, the chord of <br />said curve bears South 71°49’50” West; thence South 12°55’50” East 262.41 feet; thence South <br />01°21’07” East 399.16 feet; thence North 88°38’53” East 305.00 feet to the East line of said <br />Government Lot 4; thence North 01°21’07” West along said East line 764.33 feet to the point of <br />beginning; and <br />7) All that part of Government Lot 4, Section 10, Township 29 North, Range 21 West, Washington <br />County, Minnesota described as follows: Commencing at the Northeast corner of said Government <br />Lot 4; thence South 01°21’07” East, bearing oriented to the Washington County Coordinate <br />System, South Zone, along the East line of said Government Lot 4 a distance of 10.15 feet to the <br />center line of Lake Jane Trail, as presently traveled; thence Southwesterly along said center line <br />and a curve, concave to the south, having a radius of 1145.92 feet and a central angle of 18°45’59” <br />a distance of 375.33 feet to the point of beginning, the chord of said curves bears South 71°49’50” <br />West; thence continue southwesterly along said center line and said curve, concave to the <br />southeast, having a radius of 1145.92 feet and a central angle of 01°42’22” a distance of 27.57 <br />feet; thence South 61°04’09” West along tangent and along said center line 168.40 feet to the <br />northeast corner of Berschens Shores 2nd Addition, according to the recorded plat thereof; thence <br />South 16°44’50” East along the east line of said Berschens Shores 2nd Addition 234.30 feet; <br />thence North 65°35’10” East 176.40 feet; thence North 12°55’50” West 252.36 feet to the point <br />of beginning. <br />Abstract Property <br />(the “Property”). <br />Based on my review of the Commitment and the Preliminary Plat, I have the following comments <br />regarding the minor subdivision application: <br />1. Ownership Interests. According to the Commitment, the owners of the Property are: John <br />A. Berschens or successor, as Trustee of the John A. Berschens Trust under Trust Agreement <br />dated January 22, 2010 (an undivided 1/2 interest), and Janet M. Berschens or successor, as <br />Trustee of the Janet M. Berschens Trust under Trust Agreement dated January 22, 2010 (an <br />undivided 1/2 interest). <br /> <br />a. The Final Plat must be executed with all the formalities of a deed of title. We have not yet <br />received from the Applicants a Certificate of Trust for either the Janet M. Berschens Trust <br />under Trust Agreement dated January 22, 2010, or the John A. Berschens Trust under <br />Trust Agreement dated January 22, 2010. The Application is made by Jean Berschens and <br />Janet Berschens, as trustees. Certain Certificate of Trust and Affidavit of Trustee <br />documents filed in 2014 in Washington County Property Records indicate that Janet M. <br />Berschens is the authorized trustee of the Janet M. Berschens Trust and that Jean <br />Berschens is the authorized trustee of the John A. Berschens Trust. We require any <br />updated Certificate of Trusts for each above-named trust, if available, in order to <br />determine if the Applicants are authorized to act under the respective trusts, and who must <br />sign to complete the minor subdivision and sign a Final Plat on behalf of each trust.
