STAFF REPORT <br />DATE: January 17, 2023 <br /> CONSENT <br /> <br />AGENDA ITEM: Approve City Oversize Cost Reimbursements for Wildflower at Lake <br />Elmo 4th Addition. <br /> SUBMITTED BY: Jack Griffin, City Engineer <br />REVIEWED BY: Kristina Handt, City Administrator Marty Powers, Public Works Director <br /> Sophia Jensen, Planner <br />Chad Isakson, Assistant City Engineer <br /> <br /> <br />ISSUE BEFORE COUNCIL: Should the City Council approve payment for the city oversize cost <br />reimbursements for the Wildflower at Lake Elmo 4th Addition? <br /> <br />BACKGROUND: The City Council approved a Development Agreement for the Wildflower at Lake Elmo <br />4th Addition, dated February 2, 2022. The Watermain and Sanitary Sewer Improvements have been <br />completed and accepted as of January 17, 2023, and the 2-year warranty period has been initiated. <br /> <br />PROPOSAL DETAILS/ANALYSIS: Staff has received and processed a request for city reimbursement <br />for the trunk watermain and trunk sanitary sewer pipe oversizing costs related to the Wildflower 4th <br />Addition. This request has been reviewed and is being recommended for approval in accordance with the <br />approved Development Agreement, and contingent on the developer being current with all other payments <br />and obligations in accordance with the Development Agreement, including a positive escrow balance as <br />required by the City. <br /> <br />FISCAL IMPACT: Oversize payments are recommended in the amounts of $20,512.00 for trunk <br />watermain oversize costs, and $9,102.00 for trunk sanitary sewer oversize cost. <br /> <br />RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda, <br />and approve payment for the city oversize cost reimbursements for the Wildflower at Lake Elmo 4th <br />Addition, contingent on the developer being current with all other payments and obligations in accordance <br />with the Development Agreement, including a positive escrow balance as required by the City. If removed <br />from the consent agenda, the recommended motion for the action is as follows: <br /> <br />“Move to approve payment for the city oversize cost reimbursements for the Wildflower 4th Addition, <br />contingent on the developer being current with all other payments and obligations in accordance with <br />the Development Agreement, including a positive escrow balance as required by the City”. <br /> <br />ATTACHMENTS: <br /> <br />1.
