JUST: <br /> <br />CEF Lake Elmo Community Solar, LLC (the “Applicant”) is providing this letter in <br />response to the amended “Recommended Conditions of Approval” approved by the <br />City of Lake Elmo Planning Commission at an in-person meeting held on Monday, <br />November 22, 2021. We appreciate this opportunity to provide revisions and <br />responses to the “Recommended Conditions of Approval” prior to Lake Elmo City <br />Council consideration of our CUP application. <br /> <br />For clarity the “Recommended Conditions of Approval” are restated below in <br />quotations and our responses are provided in italics. <br /> <br />1. “The applicant shall revise all project plans to address the review comments <br />of the City Engineer in the memo dated November 13, 2021.” <br /> <br />The City Engineer memo contained numerous review comments. Below we <br />restate each comment in quotations in the order and format shown in the <br />memo. Our responses are provided in italics following each comment. <br /> <br />“RIGHT‐OF‐WAY PRESERVATION <br />• The Site Plan shows right‐of‐way preservation along 50th Street <br />North, measured 59 feet from the existing centerline. The minimum <br />right ‐of ‐way preservation must be 60 feet. In addition, all <br />setbacks along 50th Street North and Lake Elmo Avenue should be <br />measured from the roadway preservation easements/rights of‐way <br />(60‐feet from existing centerlines). Right‐of‐way preservation is <br />required per the Lake Elmo and Washington County 2040 <br />Comprehensive Plans (2‐lane undivided Collector Roadways).” <br /> <br />A site plan and certified ALTA/NSPS Land Title Survey is provided <br />as Appendix A. The survey shows the right-of-way preservations <br />along 50th St N and Lake Elmo Avenue, as deeded. All proposed <br />improvements meet the required 60-foot right-of-way preservations. <br /> <br />
