Chapter 153 Water Resource Management Adopted 6/28/2022 <br /> Page 30 of 34 <br />i.Stockpile Testing. The stockpile shall be tested prior to re-spreading. Sample results must be <br />submitted to County staff a minimum of 2 business days prior to re-spreading. Topsoil test <br />results are valid for one year. <br />(2)Import Material and Spread. If topsoil is not available on-site due to previous construction <br />activity and existing material cannot be amended to meet the Carver County Topsoil Standard, <br />topsoil meeting the standard shall be imported to the site. <br />(D)Submittal Requirements. A “Topsoil Management Plan” shall be submitted as part of the application for <br />Erosion and Sediment Control permits and shall include information on the topsoil management <br />strategies to be utilized to maintain soil permeability at or above required standards. Required <br />components of the topsoil management plan are outlined in section § 153.43(I). <br />§ 153.63 UPSTREAM AND DOWNSTREAM IMPACT STANDRADS. <br />(A)Upstream. Drainage flowing onto the site from upstream areas must be managed and accommodated. <br />Alterations to flow paths which impound or slow down water will not be allowed unless it can be shown <br />that the upstream system can accommodate the change. Proposed rates, volumes, velocities, and <br />duration of flow may be requested in order to document that any impacts are nonexistent or <br />insignificant. <br />(B)Downstream. <br />(1)To the extent possible, existing drainage areas and discharge points from the site should be <br />maintained post-development and concentrated flows onto neighboring properties should be <br />avoided or mitigated. The downstream conveyance system (natural or structural) must be able to <br />accommodate, to the nearest major receiving waterbody, increased volumes caused by <br />development. <br />(2)If diversions from existing drainage areas and alterations to discharge points are proposed, the <br />responsible party shall provide additional documentation (rates, volumes, velocities, duration of <br />flow, etc.) to demonstrate that the downstream conveyance system can accommodate the change. <br />The responsible party shall provide evidence of easements or other agreements concerning water <br />flow if a plan involves increased impervious or directing concentrated runoff onto a neighboring <br />property. <br />(3)If diversions from existing drainage areas, alterations to discharge points, increased duration of flow, <br />or additional runoff volumes are proposed, the responsible party shall provide additional <br />documentation (rates, volumes, velocities, duration of flow, etc.) to demonstrate that the <br />downstream conveyance system can accommodate the change. The responsible party shall provide <br />evidence of mitigation, easements or other agreements concerning water flow if a plan involves <br />increased impervious or directing concentrated runoff from onto a neighboring property. <br />§ 153.64 CONSERVATION AREA STANDARDS. <br />(A)Upland preservation areas placed under conservation easement must be placed in outlots or other <br />publicly owned or accessible land. <br />(B)Fencing between conservation areas and private property may be required in some circumstances.
