5 <br />RECOMMENDED CONDITIONS OF APPROVAL <br />Staff and the Planning Commission recommend the following conditions as part of an approval: <br />1. The City Engineers’ comments shall be addressed prior to the City’s release of the final <br />plat. <br />2. The City Attorney’s comments related to the plat opinion shall be resolved prior to the <br />City’s release of the final plat. <br />3. Platting fees, including park dedication, shall be paid prior to the City’s release of the <br />final plat. <br />4. Development fees such as utility access and connection fees, AUAR fee, etc. shall be <br />paid with building permits. <br />5. That the developer records the approved Final Plat with Washington County within 180 days <br />after City Council approval. Failure to record the Final Plat within 180 days of approval will <br />cause the approval to become void. <br /> <br />FISCAL IMPACT <br />Approval of this Minor Subdivision may result in additional park dedication fees to be paid. The <br />applicant and City are researching if this fee has already been paid. The developer will have to pay for <br />any increase in lots or intensification of land-use if its determined its previously been paid. Park <br />dedication fees will have to be resolved prior to the City’s release of the final plat. When the property <br />develops it will have urban services and will pay sewer and water connection charges, building permit <br />fees and other development fees. <br /> <br />PUBLIC COMMENTS <br />A public hearing was noticed and held at the Planning Commission meeting on March 27, 2023. One <br />member of the public spoke and had questions about the ribbon markings on the trees and the timing <br />of construction of the future daycare. The ribbons were part of the tree inventory, and the timing of <br />the daycare is unknown, although it was speculated it could be under construction this summer if they <br />get their entitlements this spring. No other public comments have been received to date. <br /> <br />OPTIONS <br />The City Council may: <br />• Approve the requests. <br />• Approve the requests with conditions. <br />• Deny the requests, citing findings of fact. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br />The Planning Commission reviewed the request, heard public comments, and discussed the proposed <br />development at their regular meeting on March 27, 2023. The Commission found the request to be <br />straight forward. A motion was made to recommend approval of this item, with the findings and <br />conditions as proposed by staff and passed unanimously. <br /> <br />RECOMMENDATION <br />Staff and the Planning Commission recommend that the City Council approve the Minor <br />Subdivision request from Frisbie Properties LLC to divide this parcel of the Brookman 3rd <br />Addition into two separate parcels. <br /> <br />Motion to adopt Resolution 2023-32 approving the Brookman 3rd Addition Minor Subdivision <br />based on the findings of fact and conditions presented in the staff report.” <br />
