1 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2025-073 <br />RESOLUTION APPROVING A NEGATIVE DECLARATION ON THE NEED FOR AN <br />ENVIRONMENTAL IMPACT STATEMENT FOR THE LIMERICK VILLAGE DEVELOPMENT <br />PROJECT <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the laws of the State of Minnesota require that an Environmental <br />Assessment Worksheet (EAW) be prepared for construction of a permanent or potentially <br />permanent residential development located in the seven-county Twin Cities metropolitan area <br />equal to or in excess of the thresholds listed in Minnesota Rules 4410.4300 Subpart 19; and <br />WHEREAS, an EAW was prepared for the Limerick Village Development Project on <br />the properties in Washington County as described in Exhibit A, and reviewed by the City of <br />Lake Elmo, and the draft document was circulated for comments to the required State and <br />Federal agencies, as provided by law; and <br />WHEREAS, notice of availability of the EAW was published in the EQB Monitor on <br />August 26, 2025, and the thirty-day comment period ended on September 25, 2025, and during <br />such period comments were received from two public agencies; and <br />WHEREAS, the City Council is required by law to make a finding on the adequacy of <br />the EAW and to determine whether an Environmental Impact Statement (EIS) should be <br />prepared; and <br />WHEREAS, the City Council met at a regularly scheduled meeting on October 21, 2025, <br />and considered the EAW, the reports of its staff, and the comments received from the parties as <br />noted above. <br />NOW, THEREFORE, BE IT RESOLVED THAT by the City Council of the City of <br />Lake Elmo that the City Council makes the following findings with regard to the environmental <br />impact of the proposed Limerick Village Development Project: <br />1.The Environmental Assessment Worksheet (EAW) and related documentation for the <br />Limerick Village Development Project were prepared in compliance with the procedures <br />of the Minnesota Environmental Policy Act and Minnesota Rules 4410.1000 to 4410.1700. <br />All requirements for environmental review of the proposed project have been met.
