8 <br />LA515\160\1053952.v2 <br />to direct attention to detours. If and when streets become impassable, such streets shall be <br />barricaded and closed by the Developer. In the event residences are occupied prior to completing <br />streets, the Developer shall maintain a smooth surface and provide proper surface drainage to <br />ensure that the streets are passable for traffic and emergency vehicles. The Developer shall be <br />responsible for keeping streets within and without the Subdivision clean and clear of dirt and <br />debris that may spill, track, or wash onto the street from the Developer’s operations. The <br />Developer shall contract for street cleaning for streets within and immediately adjacent to the <br />Subdivision. At a minimum, scraping and sweeping shall take place on a weekly basis and on a <br />daily basis during heavy tracking days. <br />13. LICENSE. The Developer hereby grants the City, its agents, employees, officers, and <br />contractors a license to enter the Property to perform all work and inspections deemed <br />appropriate by the City in conjunction with the development of the Property and this Agreement. <br />14. CONSTRUCTION ACCESS. Construction traffic access and egress for all building and <br />Subdivision Improvements is restricted to access the Subdivision via Island Trail North and 5th <br />Street North at the approved designated rock construction entrances per the approved erosion <br />control plans. All construction parking and staging, including the loading and unloading of <br />equipment and supplies during the construction of the Subdivision Improvements must be <br />completed interior to the Subdivision and are not allowed to occur on any adjacent public street or <br />public right-of-way, including, but not limited to Island Trail North and 5th Street North. The Developer <br />and its contractors shall be responsible for the repair and restoration of any damage to any street, <br />curb, trail, sidewalk, and boulevard caused by the construction activities. All such repairs shall by <br />inspected by the City and meet all City standards and specifications. <br />The Developer must maintain adequate access for emergency vehicles that is acceptable <br />to the City in its sole discretion at all times during construction. <br />15.
