1 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2025-066 <br />RESOLUTION APPROVING THE INWOOD TOWNHOMES 1ST ADDITION EASEMENT <br />VACATION <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, M/I Homes of Minneapolis/St. Paul, LLC. (the “Applicant”) submitted an <br />application to the City of Lake Elmo for an easement vacation, for the property legally described <br />on the attached Exhibit A (the “Property”), a copy of the easement vacation is on file in the City <br />of Lake Elmo Community Development Department; and <br />WHEREAS, the proposed Inwood Townhomes 1st Addition Easement Vacation request <br />includes an existing drainage and utility easement that is to be vacated and rededicated within the <br />Final Plat; <br />WHEREAS, the easement to be vacated is further depicted on Exhibit B attached <br />hereto; and <br />WHEREAS, pursuant to Minnesota Statutes Section 412.851, the City scheduled a <br />public hearing for October 7th, 2025, to consider the proposed vacation of the Drainage and <br />Utility Easements; and <br />WHEREAS, notice of the public hearing was posted, published in the City’s official <br />newspaper, and mailed to the owners of affected properties, all in accordance with the law; and <br />WHEREAS, the City held the public hearing on the proposed vacations on October 7th <br />2025 at which hearing all interested parties were heard; and <br />WHEREAS, following the public hearing, the City determined that the vacation of the <br />Drainage and Utility Easements are in the public interest because replacement of easements will <br />be dedicated to the City in the Inwood Townhomes 1st Addition final plat. <br />WHEREAS, the City Council reviewed the Inwood Townhomes 1st Addition Easement <br />Vacation at its meeting held on October 7th, 2025, and made the following findings of fact: <br />1.That the Inwood Townhomes 1st Addition Final Plat, PUD, and Easement Vacation is <br />generally consistent with the Preliminary Plat and PUD Plans as approved by the City of <br />Lake Elmo on June 17th 2025.
