LA515\161\1061713.v3 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2025 - 080 <br />A RESOLUTION APPROVING REGISTERED LAND SURVEY NO. 132 FOR THE <br />PROPERTY LOCATED AT 3481 LAVERNE AVENUE <br />WHEREAS, the City of Lake Elmo (the “City”) is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, John Pecchia and Chama Mission LLC (the “Applicants”) submitted an <br />application to the City for a Registered Land Survey (“RLS No. 132”) to reconfigure the <br />property with the address of 3481 Laverne Avenue into two separate parcels as shown on RLS <br />No. 132, a copy of which is on file in the City of Lake Elmo Planning Department; and <br />WHEREAS, the Lake Elmo Planning Department has reviewed the proposed RLS No. <br />132 for consistency with the City’s zoning and subdivision regulations; and <br />WHEREAS, the Lake Elmo Planning Commission held a public hearing on October <br />15th, 2025, to review and consider RLS No. 132; and <br />WHEREAS, the consensus of the Lake Elmo Planning Commission was to recommend <br />to the City Council approval of RLS No. 132 subject to certain conditions of approval; and <br />NOW, THEREFORE, the City Council of the City of Lake Elmo makes the following <br />findings of fact: <br />1.That the Registered Land Survey No. 132 is consistent with the Lake Elmo <br />Comprehensive Plan and the Future Land Use Map for this area. <br />2.That RLS No. 132 is consistent with the standards of the with the City’s Village <br />Mixed Use zoning district. <br />3.That RLS No. 132 meets the requirements of the City’s Registered Land Survey <br />and Minor Subdivision regulations. <br />NOW, THEREFORE, BE IT FURTHER RESOLVED THAT the City Council does <br />hereby approve RLS No. 132 subject to the following conditions: <br />1. The Applicants must obtain all other necessary City, state, and other governing <br />body permits and approvals prior to release of RLS No. 132 for recording. <br />2. The City Attorney’s comments set forth in the RLS opinion shall be addressed prior <br />to release of RLS No. 132 for recording. <br />3. The City Engineer’s comments set forth in the memo dated September 23, 2025 <br />shall be addressed to the satisfaction of the City (as may be amended) prior to
