1 <br />LA515\1\1054527.v3 <br />CITY OF LAKE ELMO <br />COUNTY OF WASHINGTON <br />STATE OF MINNESOTA <br />ORDINANCE NO. 2025-017 <br />AN ORDINANCE AMENDING THE LAKE ELMO CITY CODE OF ORDINANCES BY <br />AMENDING CHAPTER 11.04 RELATING TO LAWFUL GAMBLING <br />SECTION 1. The City Council of the City of Lake Elmo hereby ordains that Chapter 11.04 <br />of the City’s Code of Ordinances is hereby amended by changing the following Sections <br />11.04-I – 11.04-III (proposed language is underlined, deleted language is shown with <br />strikethrough): <br />11.04.160. Definitions <br />For purposes of LEC 11.04.160 – 11.04.250, the following terms shall have meanings ascribed to <br />them as follows: <br />(a) Board. The Minnesota gambling control board. <br />(b)Fraternal organization. A 501(c)(8) or 501(c)10 nonprofit organization that is a <br />branch, lodge, or chapter of a national or state organization, and exists for the <br />common interests of its members. Fraternal organizations do not include high <br />school and college fraternities and sororities. <br />(c)Other nonprofit organization. 1) an organization with a current letter of tax <br />exemption from the Internal Revenue Service (IRS); 2) an organization re- <br />incorporated as a nonprofit corporation and registered with the Minnesota Office <br />of the Secretary of State; or 3) an affiliate, subordinate, or chapter of a statewide <br />parent nonprofit organization. <br />(d)Religious organization. A nonprofit organization, church, group of church <br />members, or group gathered for support and moral improvement in religion, <br />worship, and religious observances. <br />(e)Trade area. The cities of Lake Elmo, Oakdale, Grant, Oak Park Heights, and <br />Woodbury, and the townships of Baytown, and West Lakeland, all bordering the <br />city of Lake Elmo. Also, the school districts of Stillwater Area Public Schools, <br />North St. Paul-Maplewood-Oakdale Schools, and Mahtomedi Public Schools. <br />(f)Veterans organization. A congressionally chartered organization in Minnesota, or <br />any branch, lodge, or chapter of a nonprofit national or state organization in <br />Minnesota, with a membership of people who were in the United States armed <br />services or forces.
