3 <br />LA515\1\1054527.v3 <br />warrant, all records of a licensed organization, including gambling accounts and <br />other bank records which are required, by the state lawful gambling control board, <br />to be maintained and preserved. <br />11.04.180 Approval of Premises Permit <br />(a)Notification of application. An organization applying for a lawful gambling license <br />must also apply for a premises permit to conduct lawful gambling at any specific <br />location within the city. Therefore, the organization desiring to conduct lawful <br />gambling at a location within the city must make an application to the city for a <br />premises permit. The state lawful gambling control board shall notify the council <br />in writing in the manner required by law of each pending application for a premises <br />permit at least 60 days before issuing or renewing the license. Each pending <br />application for a premises permit shall be approved or disapproved by resolution of <br />the council. <br />(b)Premise permit application Filing. Any organization applying to the state lawful <br />gambling control board for a premises permit to conduct lawful gambling at any <br />specific location within the city bingo hall license, or for the renewal of the <br />premises permit to conduct lawful gambling in the city shall, within ten days of <br />submitting the application for the premises permit with the board, file a premises <br />permit application that must include a copy of the applicant’s application with the <br />state following with the city administrator:. <br />(1)A duplicate copy of the state lawful gambling control board application along <br />with all supporting documents submitted to the state lawful gambling control <br />board; <br />(2)A copy of the articles of incorporation and bylaws of the organization; <br />(3)The names and addresses of all officers and directors of the organization; <br />(4)A copy of the organization's written procedures and/or criteria for distribution <br />of funds derived from lawful gambling, its standardized application form, and <br />its written fiscal control procedures; and <br />(5)A copy of the Internal Revenue Service's tax exempt letter. <br />(c)Investigation. Upon receipt of the materials required by subsection (b) of this <br />section and not later than 60 days from receipt of notice from the state lawful <br />gambling control board, city staff shall investigate the applicant and, based upon <br />the investigation, the council shall act on the application. <br />(d)Approval; denial. The action of the council to approve an application for a premises <br />permit or a bingo hall license within the city shall be by resolution. Failure to <br />receive three affirmative votes of the city council shall constitute a denial of the <br />application. <br />(e)Resolution. A copy of the council resolution will be sent to the board and the license <br />premises permit applicant upon request.
