CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2025-079 <br />A RESOLUTION APPROVING THE FIRST AMENDMENT TO THE DEVELOPMENT <br />AGREEMENT FOR PRAIRIE SKY TWINHOMES <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Prairie Sky Twinhomes LLC (the “Applicant”) has previously submitted an <br />application to the City of Lake Elmo (the “City”) for a final plat for Prairie Sky Twinhomes; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2023-076 on August <br />15th 2023 approving the final plat for Prairie Sky Twinhomes; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2024-089 on August <br />20th 2024 approving the Development Agreement for Prairie Sky Twinhomes; and <br />WHEREAS, the Applicant and the City have agreed to amend the Development <br />Agreement for Prairie Sky Twinhomes; in order to allow building permits to be issued prior to <br />public improvement acceptance by the City and prior to the installation of sidewalks; and <br />NOW, THEREFORE, based on the information received, the City Council of the City of <br />Lake Elmo does hereby approve the First Amendment to Development Agreement for Prairie Sky <br />Twinhomes, authorize the City Attorney to draft the First Amendment to the Development <br />Agreement to include provisions to allow building permits to be issued prior to sidewalk <br />installation consistent with the language in the Northstar 1st Addition and At Home Apartments <br />Development Agreements, and authorize the Mayor and City Clerk to execute the First <br />Amendment to Development Agreement. <br />Passed and duly adopted this 2nd day of December 2025 by the City Council of the City of Lake <br />Elmo, Minnesota. <br />__________________________________ <br />Charles Cadenhead, Mayor <br />ATTEST: <br />_______________________________ <br />City Clerk
