81 12/2024 <br /> <br /> <br />#260 DRUG & ALCOHOL – FREE WORKPLACE <br /> It is the policy of the City of Lake Elmo to maintain a drug and alcohol-free work environment that is safe <br />and productive for employees, its citizens, and others doing business with the City. <br /> <br />The unlawful use, possession, purchase, sale, or distribution of, or being under the influence of any illegal <br />drug or controlled substance while on City premises or while performing services for the City is strictly <br />prohibited. Violations of this policy will result in disciplinary action, up to and including termination, and <br />may have legal consequences. The City of Lake Elmo also prohibits reporting to work or performing work <br />duties under the influence of alcohol and cannabis or consuming alcohol and cannabis while on duty or <br />during work hours. In addition, the City prohibits off-premises abuse of alcohol, cannabis, and controlled <br />substances, as well as the possession, use, or sale of illegal drugs, when these activities adversely affect job <br />performance, job safety, or the City’s reputation in the community. <br /> <br />Employees are expected and required to report to work on time and in appropriate mental and physical <br />condition. It is the city’s intent and obligation to provide a drug- free, alcohol- free, safe, and secure work <br />environment. <br /> <br />The city recognizes drug abuse as a potential health, safety, and security problem. Employees needing help <br />in dealing with such problems are encouraged to use their health insurance plans as appropriate and may <br />contact the administrative services director for other resources. <br /> <br />THE CITY OF LAKE ELMO PROHIBITS THE FOLLOWING: <br />• No employee shall report to work under the influence of alcohol, cannabis, controlled Substances, <br />or other drugs which affect their alertness, coordination, reaction, response, judgment, decision- <br />making, or safety. <br />• No employee shall operate, use, or drive any equipment, machinery, or vehicle of the City while <br />under the influence of alcohol, cannabis, controlled substances or other mood-altering drugs. Such <br />employee is under an affirmative duty to immediately notify their supervisor that they are not in an <br />appropriate mental or physical condition to operate, use, or drive the City’s equipment or vehicles. <br />• No employee shall unlawfully manufacture, distribute, dispense, possess, transfer, or use a <br />controlled substance in the workplace or wherever the City’s work is being performed. <br />• Engaging in off-duty sale, purchase, transfer, use or possession of illegal drugs or controlled <br />substances may have a negative effect on an employee’s ability to perform their work for the City. <br />In such circumstances, the employee is subject to discipline. <br />• When an employee is taking medically authorized drugs or other substances which may alter job <br />performance, the employee is under an affirmative duty to notify the appropriate supervisor of their <br />temporary inability to perform the job duties of their position. <br /> <br />To ensure compliance with this policy, please refer to the City of Lake Elmo’s Drug, Alcohol, and <br />Cannabis Testing Policy for more information. <br /> <br />Notwithstanding any provision herein, this policy will be enforced at all times in accordance with applicable <br />state and local law. Any employee violating this policy is subject to discipline, up to and including <br />termination. <br /> <br />Employees must, as a condition of employment, abide by the terms of this policy and must report any <br />conviction under a criminal drug statute for violations occurring on or off work premises while conducting <br />city business. A report of the conviction must be made within five (5) days after the conviction as required <br />by the Drug-Free Workplace Act of 1988.
