5 <br />4. The driveway access area must be brought up to code ahead of any building <br />permits for redevelopment, per the Engineering memo dated September 23, <br />2025. <br />5.Prior to recording RLS No. 132, the Applicants must dedicate right of way by <br />separate easement to the satisfaction of the City, per the Engineering memo <br />dated September 23, 2025. <br />6.All proposed easements shall be subject to review and approval by the City <br />Attorney and the City Engineer prior to the release of RLS No. 132 for <br />recording. The drainage and utility easement must be established along the entire <br />north side of the building, extending from the eastern property line to the western <br />property line, and shall encompass all areas outside of the building’s footprint. <br />The final location and dimensions of the easement shall be approved by the City <br />Engineer prior to recording of RLS No. 132. <br />7. The Applicants shall record RLS No. 132 and this Resolution within 180 days <br />after approval of this Resolution by the City Council and provide proof of <br />recording to the City. If both are not recorded within 180 days, approval of RLS <br />No. 132 shall be considered void, unless a request for a time extension is <br />submitted in writing and approved by the City Council. <br />Explanation: <br />•Conditions #4, #5, & 6 are recommendations from the Engineering Memo dated <br />9/23/2025. Originally, these conditions were grouped together as Condition #4 in the <br />original PC memo. That condition was an attempt to capture all of the engineering memo <br />in a single condition. However, because other items from the memo are separated into <br />their own conditions, staff have decided to remove it and replace it with the remaining <br />memo item regarding paving driveway access for transparency. <br />•Original Conditions #7 & 8 have been removed. Staff originally added these <br />conditions for transparency. After hearing from the applicant, staff has since <br />removed the conditions to ensure that the applicant can conduct regular maintenance <br />on buildings on the property if needed. All code requirements are still applicable <br />and are expected to be addressed when redevelopment occurs. <br />•Condition #6 has been updated to provide clarity as to where the easement area for a <br />drainage and utility easement must be located before recording the registered land <br />survey. Because there are no connection plans to review at this time, the intention <br />with this blanket easement is to ensure flexibility for any future development to the <br />east. When the applicants provide a plan, the easement area may be reviewed and <br />potentially revised/vacated. <br />Utilities and Access (Condition #6): The engineering memo addresses concerns related to <br />utilities to the site and how they will connect to the site to the east. The drainage and utility <br />easement is required to ensure flexibility for any future development to the east. The easement is
