• A trail connection is desired linking the public street in this development with the City of <br />Oakdale. <br />• Oakdale desires to review stormwater management plans, when available. <br /> <br />Valley Branch Watershed District - The Developer has met with VBWD and is responsible for meeting <br />applicable rules and seeking necessary reviews or permits. <br /> <br />Summary of Nonstandard Elements and Considerations <br />Stormwater Ponds and Infiltration/Filtration Basins in private lots: <br />• Pros <br />o Allowing stormwater management BMPs on private lots reduces the overall <br />number of publicly owned parcels. <br /> <br />• Cons <br />o Homeowner misunderstanding & noncompliance. Many owners don’t understand <br />easement restrictions or the rights of Cities to maintain stormwater basins and <br />drainage systems, leading to filling, mowing, or encroachments by fencing, dog <br />fences, irrigation system placements, retaining walls, tree plantings, playgrounds, <br />patios and fire pits, and other obstructions, in particular, along maintenance access <br />routes. Homeowners take control of the property and obstruct maintenance. Cities <br />must issue notices, citations, or restoration orders when homeowners encroach City <br />easement areas. <br />o Access challenges. City staff is required to enter private property for inspections or <br />repairs, which can cause disputes leading to increased homeowner conflicts over <br />the maintenance and vegetation standards, rutting repairs, etc., following all public <br />works maintenance mobilizations. <br />o Maintenance Delays and Inefficiencies. City standard maintenance activities often <br />are delayed and require difficult enforcement activities before proceeding. <br />o Reduced functionality and pollutant removal efficiency. Cities must maintain <br />stormwater systems under MS4 permit obligations, and owning the land provides <br />full access and control, leading to better, more efficient long-term performance. <br />City ownership supports proper vegetation management, dredging, and compliance <br />with stormwater standards in the Minnesota Stormwater Manual. <br />o Increased Pond Dredging costs. City ownership supports the option to spread <br />dredging materials onsite rather than costly trucking and disposal of contaminated <br />materials. <br />o Potential negative impacts to density calculations. Stormwater Ponds in Public <br />Owned Outlots excluded in Met Council density calculations. <br />o Property value concerns. Owners may dislike having unusable or wet areas on their <br />lots, leading to pressure to alter or drain them—contrary to stormwater and wetland <br />regulations. <br /> <br /> <br />New Rural Road Section: <br />• Pros <br />o Less costly for developers to construct. <br />o Could allow for new or different forms of development in certain rural areas. <br /> <br />
