STAFF REPORT <br />DATE:March 3, 2026 <br />REGULAR <br />TO: Mayor and Councilmembers <br />FROM: Nicole Miller, City Administrator, Nate Stanley, City Engineer, <br />and Pete Tholen, Public Works Director <br />AGENDA ITEM: Stormwater Management Utility Code Review <br />CORE STRATEGIES: <br />☐ Vibrant, inclusive, connected community ☐ Efficient, reliable, innovative services <br />☐ Responsive, transparent, adaptive governance ☒ Balanced Finances now and future <br />☐ Managed Growth ☐ Resilient Infrastructure <br />BACKGROUND: As part of the City Council’s strategy for balancing finances for now and into the <br />future, the goal of reviewing fees was added to the most recent strategic plan. One such fee is the <br />stormwater utility fee. This fee per our city code is used for preparation of a surface water management <br />plan, maintenance of existing ditches, culverts, ponds, and storm sewers, capital improvement in <br />developed areas, equipment, planning, inventories, and water quality improvements, including weed <br />control and tree removal. <br />ISSUE BEFORE COUNCIL: Does the City Council wish to proceed with Bolton & Menk’s scope for <br />review of the stormwater utility fee? <br />PROPOSAL DETAILS/ANALYSIS: At the direction of Council from the September 9, 2025 workshop, <br />staff has prepared a preliminary cost estimate for an independent review of the City’s storm water collection <br />fee calculation methodology, associated land use categories, and appeal process. This item is being brought <br />forward to allow City Council to review the proposed scope of work as it has been a while since it was last <br />discussed, and to provide an opportunity for Council to ask questions of the City Engineer. <br />As part of the review we will also work with the City Attorney to ensure our code is compliant with state <br />law. <br />FISCAL IMPACT: This is included in the 2026 budget. This review will be paid out of the stormwater <br />fund. <br />OPTIONS: <br />1.)Approve the quote from Bolton & Menk to complete review of stormwater utility fee as outlined. <br />2.)Do not approve the quote from Bolton & Menk to complete review of stormwater utility fee as <br />outlined. <br />3.)Modify scope of the stormwater utility fee review and direct Bolton & Menk to proceed with <br />modified scope.
