The Developer and its contractors must adhere to the City’s <br />weight restrictions for all streets both inside and outside of the Subdivision, regardless of whether <br />said streets are included in the City’s map of streets with weight restrictions and regardless of <br />whether said streets are fully constructed. The Developer also is responsible to locate all <br />underground utilities until the Subdivision is accepted in writing by the City. Warning signs shall <br />be placed by the Developer when hazards develop in streets to prevent the public from traveling <br />on same and to direct attention to detours. If and when streets become impassable, such streets <br />shall be barricaded and closed by the Developer. In the event residences are occupied prior to <br />completing streets, the Developer shall maintain a smooth surface and provide proper surface <br />drainage to ensure that the streets are passable for traffic and emergency vehicles. The <br />Developer shall be responsible for keeping streets within and without the Subdivision clean and <br />clear of dirt and debris that may spill, track, or wash onto the street from the Developer’s <br />operations. The Developer shall contract for street cleaning for streets within and immediately <br />adjacent to the Subdivision. At a minimum, scraping and sweeping shall take place on a weekly <br />basis and on a daily basis during heavy tracking days. <br />Prior to the City’s acceptance of the streets, the City may agree, at the City’s sole <br />discretion, to keep the streets open during winter months by plowing snow. The City will consider <br />snow plowing streets on a case by case basis: 1) the Developer must request in writing the streets <br />it is requesting to be plowed by the City; 2) there must be residences along the street; 3) for <br />streets that do not have the bituminous wear course placed, the Developer must install paved <br />wedges along all curb lines and catch basins of the street; 4) gate valves and manholes must be <br />level with the pavement surface; 5) street curves, center medians, and other protrusions in the <br />rights-of-way must be delineated with “HI-VIS” fiberglass stakes; 6) a site review must be <br />scheduled by the Developer and conducted with the City’s Public Works Department with the <br />Developer in attendance to review the streets that are being requested to be plowed prior to the
