2 LA515\1\919211.v3 <br />(ESST) for every thirty (30) hours worked with a maximum accrual of forty-eight (48) hours in <br />each calendar year. Use of ESST is outlined in policy #230 EARNED SICK AND SAFE TIME <br />in the Personnel Policies. Any accrued ESST not used by December 31st of each year, will be paid <br />out annually. Any unused accrued ESST will not be paid out at time of termination. The Employee <br />understands that he will not be earning any Vacation paid time off. Any time off taken by the <br />Employee that does not qualify under the provisions of ESST will be without pay. <br />7. AUTOMOBILE. Employee shall be reimbursed on a per mile basis at the IRS <br />allowed deduction rate for the use of his personal automobile for Employer business. <br />8. GENERAL EXPENSES. Employer shall reimburse Employee for miscellaneous <br />job-related expenses which it is anticipated Employee will incur from time to time when provided <br />with appropriate documentation. <br />9. HOURS OF WORK. During the time serving as the Special Projects Manager, <br />Employee will work an average of 10 hours per week. <br />10. INDEMNIFICATION. Employer shall defend and indemnify Employee to the <br />extent required by Minn. Stat. § 466.07 and § 465.76. <br />11. MISCELLANEOUS PROVISIONS. This Agreement shall supersede any <br />previous agreements and oral understandings between the parties and may not be amended except <br />in writing, signed by both parties. In the event of any conflict between this Agreement and the <br />Personnel Policy, this Agreement shall take precedence. <br />IN WITNESS WHEREOF, Employer has caused this Agreement to be signed and executed <br />on its behalf by its Mayor and City Clerk, and Employee has signed this Agreement, in <br />duplicate, the day and year first written above. <br /> <br />
