Key elements of the Agreements are as follows: <br />Washington County will oversee the Project delivery of the South Frontage Road under SP 8204-57, <br />including right-of-way acquisition necessary to construct the South Frontage Road. <br />The Agreement identifies the Roadway Segment and right-of-way subject to the jurisdiction transfer by <br />MnDOT to the City of Lake Elmo as depicted in Exhibit A attached to the Agreement.The remaining <br />portions of right-of-way for the South Frontage Road will be conveyed by Washington County as part of a <br />separate process. <br />The Agreement outlines the conveyance process,including the “Notice of Release”and effective date, <br />delivery of records and conveyance documents to be provided, and responsibility of claims. <br />FISCAL IMPACT: <br />The jurisdictional transfer of the South Frontage Road to the City of Lake Elmo will be completed at no cost to the <br />City.However,once the jurisdictional transfer is completed,the City shall own and maintain,without cost or <br />expense to the State or County,60th Street North (South Frontage Road)and all improvements constructed under <br />the Project within the South Frontage Road right-of-Way.This includes all pavement,pavement markings,signing, <br />curb and gutter,storm sewer,cost share responsibilities for stormwater management,streetlights,and relocated <br />trunk watermain utilities. <br />OPTIONS: <br />1)Approve the Change of Roadway Jurisdiction Agreement, MnDOT Contract No. 1062311 as presented. <br />2)Identify proposed revisions and direct staff to further negotiate agreement terms.The contract award and <br />construction start would likely be delayed by at least 1-2 weeks. <br />RECOMMENDATION: <br />Staff is recommending that the City Council approve a Resolution approving the Change of Roadway Jurisdiction <br />Agreement,MnDOT Contract No.1062311 for a portion of the South Frontage Road Improvements to be <br />constructed under SP 8204-57.
