2.Restrict open burning in the city to areas zoned agricultural or rural residential only. These zones
reflect a safer burning environment and are less likely to generate complaint calls due to their
remoteness. Consideration must be given for these zoning types that border other residential zones.
Prairie restorations would still be allowed within the entire city when conducted by a licensed
contractor.
Consensus was to update the ordinance following recommendation #2.
The proposed ordinance is being amended to restrict open burning by city zoning areas as follows:
1. Permitted Open Burning is generally allowed to occur in areas of the City zoned as Agricultural, Rural
Single Family, Rural Residential, Rural Transitional, Open Space Planned Unit Development, and on
select Public Facilities.
2. Permitted Open Burning may be allowed to occur in areas of the City zoned as Low Density
Residential, One and Two Family Residential, Residential Estate, Village Low Density Residential, and
Village Mixed Use. Special considerations will be taken at the time of application.
3. Permitted Open Burning is not allowed in all remaining sections of the City, which includes Medium
Density Residential, High Density Residential, Village Medium Density Residential, Village High Density
Residential, and any/all Commercial districts.
4. Exception: open burning for the purpose of conducting a running fire (prairie restoration / land
management) may occur in any zoned section of the City if performed by a licensed contractor.
FISCAL IMPACT:
If the ordinance becomes more restrictive, there is a potential of a loss in revenue in permit fees. Over the past
three years, we average $1,982 in burn permit revenue.
RECOMMENDATION:
Staff is recommending that the City Council approve the ordinance as detailed in attachment 1.
Example Motions:
“Move to adopt Ordinance 2026-05, approving the amendments to 1.Ordinance 5.12-IV Open Burning.”
“Move to adopt Resolution 2026-027, approving the summary publication of Ordinance 2026-05.”
ATTACHMENTS:
1.Ordinance 5.12-IV Open Burning
2.Resolution 2026-027 - Approving Summary Publication
