CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2026-026 <br />A RESOLUTION APPROVING THE CHANGE OF ROADWAY JURISDICTION <br />AGREEMENT FOR 60TH STREET NORTH (SOUTH FRONTAGE ROAD) <br />MNDOT CONTRACT NO. 1062311 <br />WHEREAS, Washington County intends to construct, under SP 8204-57, a South Frontage Road <br />from Keats Avenue to approximately 0.4 miles East of Lake Elmo Avenue (CSAH 17), hereinafter referred <br />to as ("Roadway Segment'); and <br />WHEREAS, MnDOT has determined that a portion of the Roadway Segment is no longer needed <br />for trunk highway purposes; and <br />WHEREAS, the City of Lake Elmo is a Road Authority as defined in Minnesota Statutes § 160.02 <br />(subd. 25); and <br />WHEREAS, MnDOT and the City of Lake Elmo agree that the City of Lake Elmo is the proper <br />road authority for the Roadway Segment; and <br />WHEREAS, Cooperative Construction Agreement #1060495 between MnDOT, Washington <br />County and the City of Lake Elmo addresses cost participation and maintenance not covered in this <br />Agreement; and <br />WHEREAS, MnDOT and the City of Lake Elmo have entered into this Agreement to provide for <br />the orderly release of the Roadway Segment to the jurisdiction of the City of Lake Elmo; and <br />WHEREAS, Minnesota Statutes §161.20 authorizes MnDOT to enter into agreements with other <br />governmental authorities to carry out the purposes of Minnesota Statutes Chapter 161. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKE ELMO, that the <br />City of Lake Elmo enter into MnDOT Agreement No. 1062311 with the State of Minnesota, Department <br />of Transportation to provide for transfer of a portion the Roadway Segment to the City, under State Project <br />No. 8204-57. <br />BE IT FURTHER RESOLVED that the Mayor and the City Clerk and hereby authorized to execute <br />MnDOT Contract No. 1062311 and any amendments, on behalf of the City of Lake Elmo. <br />ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE FIFTH DAY OF MAY 2026. <br />(Seal) <br />ATTEST: <br />CITY OF LAKE ELMO <br />By: Mz-,� <br />Charles Cadenhead <br />Mayor <br />
